I wonder how the government officials are going to view gay porn producers since this episode happen to Cobra? Correct me if I'm wrong but doesn't this usually happen in str8 adult video companies but rarely in gay adult production studios?
Also Cobra is such a big studio...didn't he check the ID's and can't the model also be held responsible if he is truly under 18 years age? If the model came into Cobra with a fake ID and it looked real I think we all would have accepted it, but if the ID was truly fake, shouldn't the model be held responsible for false ID?
I think I'm going to raise our age limit to 21 years old....
Yeah, I actually asked this question to the legal panel at internext 3 years ago. Should we, as webmasters and custodian of records, take the same class that bartenders and ABC officials take in order to spot a fake ID. Their response (this was Larry Walters talking) is that it would be overkill and that if a model supplies a fake ID, then it is they who are breaking the law. There was some discussion, but I left with the impression of "the more you can do to protect yourself, the better off you will be." I have actually taken and passed the ABC course, so I can spot a fake ID, although I have never had one come across my desk, thank god.

My Partner Eddie took a similair course...he use to be a bartender and he can spot a fake ID! I guess some things come in handy.....
We've discussed this with our counsel a couple of times since we do have some models that look young but are unquestionably of legal age.
Basically, the producer must take reasonable precautions to ensure that his or her model is over 18; 2257 requires that the producer physically inspect the ID, rather than relying on a photocopy or scan that could easily be doctored with photoshop. Having multiple IDs (birthdate, drivers license, etc) is good but not foolproof.
Additionally, if the producer has any reason to suspect that the model is under 18 (hears a rumor from someone, gets an anonymous email, etc), the producer would be wise to do further verification.
We've never had to do it, but AJ and I have already decided that our action would be to require the model to either physically appear with us at the DMV that issued his license or sign a release allowing us to do so on his behalf so that we can verify with a government authority that the ID is accurate and legitimate. If the model refused, we would try to verify via another means (Choicepoint or credit data or birth records) and if we couldn't get a verification, assume the ID is fraudulent and immediately pull all the product and notify everyone who has it. Perhaps it's overkill, but because we are ethically opposed to CP as well as because the laws are very clear, to us, it seems like the only reasonable course of action.
The other thing is... my understanding is that if a producer shoots a model in good faith (model provides an ID that proves to be false later), the producer wouldn't be guilty of CP *if* that the producer takes action as soon as s/he suspects or knows (or reasonably should have known) that the model in question is underage. If the producer continues to distribute content with a model that s/he knows or reasonably suspects is underage, then s/he loses the safe harbor and good-faith exemptions that exist, and would be guilty of child pornography.
As has been pointed out, Cobra still had the videos up as of earlier today, and the quote in AVN from the owner said something like "It's just allegations." Perhaps it's part of a plan, but that's certainly not the approach I'd be taking.
The other thing I learned recently is that one cannot even legally ship CP product back to the distributor or studio; it must be destroyed, or sealed in a box, (preferably kept locked up) and the FBI called to pick up and dispose of it.
I'd hope that as long as we as an industry stand firm in our opposition to CP, and take appropriate actions immediately when it is discovered, that the justice department and the public will see that we're serious about protecting kids.

If so , how young do you feel comfortable promoting? I'm not asking these questions to attack you, or make judgement calls, I'm just trying to see how you see it.

I read that as well and it said alligations, which means innocent until proven guilty.. that's why I was curious how Chad was involved and why he had a birth certificate for this kid.

On the flip side... if this company recruits in a dubious ways and help kids get fake ID's, or manipulates them... then they deserve what they get.

I've been hearing, from people on the video side of the business, that there's been an ongoing dispute between Bryan (Cobra) and Brent Corrigan over a breach of contract. Bryan's asserted that "Brent" is attempting to start his own production company (with the financial assistance of some un-named investors) contrary to an agreement he had with Cobra. So it's possible this whole thing is an escalation of that dispute. Maybe Chad represents the investors? The AVN article stated Chad as saying that "Brent" wants the product destroyed out of remorse or something? This is all very confusing. But I would think that it shouldn't take long to authenticate an ID, so hopefully we'll all know something soon. Up to now, there's been no proof one way or the other, so for my part I'm cautious about jumping to conclusions.
well that's a bit much to say Chad represents the investors. Or is one himself. That'd hardly be ethical of him to present himself as the performer's attorney when it's a personal business interest that he's really after. I think it's irresponsible to introduce such a notion.
