    Buying Exclusive Content advise needed

    Hi all,

    Im thinking about and costing out a new idea for a site, i want at least 50% exclusive content.

    When you buy exclusive sets, do you automaticly get resale rights? Can i automaticly give some of the images to people to promote the site? should i expect that or does it vary?

    Also if the site failed, could i sell on the content?

    What type of questions should i be asking the producers and also is should i expect to pay 100% upfront or a deposit or on delivery?

    Yes, you should automatically get FULL rights to the content and thats what you should ask for at the time of ordering it.

    'Id like to order some exclusive content shoots with full rights'

    That basically means that once the content originals and encoded/touched up versions are delivered to you, you can do what you like with them, web, magazine, dvd, resell, whatever you want

    Depending on who you order from, expect to pay around 50% of the total order upon ordering, unless the shoots will be spread out across several weeks/months and 50% upon deliver and completion.

    Never pay 100% upfront, if someone wants you to do that, they are in the wrong business and i dont think i have ever been asked for 100% up front for content shoots.

    Thanks Lee, i thought that would be the case but one photographer has said i cant resell. I dont want to but if i change my mind that has to be an option.

    If you cant resell it, dont order it.

    The whole point of you ordering exclusive content is that you own it in its entirity.

    It sounds like what would have happened in that instance is you pay the photographer for all his work he sends you the content, then he resells it and packages up in a DVD and makes money above and beyond what you have already paid him.

    Thanks Lee. Thats not exclusive then. Not touching that! I want sets that are not all over the place which is why i want exclusive. Him selling it on after me damages that.

    agreed! , rules/regulations vary from photographer/company/etc. concerning content.

    Prices

    One price if you use it on your website and another price if you use it for magazines or for DVD. For example I ask $400-500 for duo move for web but if you need resell or DVD rights this cost $1500-2000.

    Thats crazy, i can get web rights, magazine usage and DVD rights for as little as $300 per 20 minute movie shoot, with stills add an extra $100 on to that price.

    For duo $500 per scene.

    That would be euro content. Am I correct?

    Prices vary greatly depending on photo quality (pro, pro-am, amateur), model quality (pornstar vs. amateur), niche, fetish (a bareback leather shoot is probably going to cost more than 2 guys on a couch sucking each other), country of origin (eastern-euro is usually MUCH cheaper than So. Cal.), etc. Also who the photographer sells to is a big factor. I would guess that Playgirl.com does not pay $300 for a 20 minute video shoot... probably more like $3,000.

    You can buy a 3 pack of Tshirts at Target for $5 or you could buy a Dolce&Gabanna Tshirt at Saks for $300. It's the same with content.

    and this is one of the main reasons i do not discuss price here.

    if 20 people buy 1 video/photoshoot of a model for example i can see how someone can sell it for $34.95 (the cost of hiring the model , filming/photographing , editing , etc. is split between the 20 people) but that to me is not "exclusive-only" (more like "exclusive-limited")
    i cannot produce the same deal for just one person (the cost of the model averages $300.00) there is no way i can make back my investment. (honest! , i've done the math)
    "exclusive-content" is not something you start off with ( unless of course your making it , and i encourage you all to try your hand at photographing ) it's something you work up to and/or something you get for your members on special ocassions/holidays/etc.

    With a good company exclusive means exclusive to the client and that means you can do whatever you want with the content, because you own all the rights. When we shoot exclusive and we ship it to the client, we keep a back up until they approve it and we delete it after.

    Thats what i want. From im hearing some of the cheaper shooters are actually scamming, by selling your "exclusive" sets on to multiple clients.

    Would that a fair assesment?

    I started off just wanting pics on my tour that no one else had. Now after alot of great advise, the resell rights are vital too me.

    Because exclusive content can be too costly for a start-up site, you may actually be better off trying to share exclusive content with another webmaster or 2. It makes it much more affordable and the content does not get overexposed so easily.

    I should also look at semi exclusive providers, any one have any list of who does this?

    In the new year i may approach some webmasters about licensing some of their sets. I would be willing to do a single site lisence and maybe use it only in my members area or tour pages. Worth asking i guess!
