    Kink.com Files Infringement Complaint

    MIAMI — Kink.com today filed a multimillion-dollar copyright and trademark infringement suit against the operator of DrTuber.com, a porn tube site that is alleged to have made available 75 Kink movies on its site.

    Kink.com said DrTuber allegedly poached and streamed such working titles as "12789_Asphyxia_James," "13810_skin," "12345_kiki_chloe" and "11815_lorelei_lily."

    Kink produces numerous BDSM and fetish brand such as Hogtied, Public Disgrace and The Upper Floor.

    "As of the date of this complaint, a total of 75 instances of infringement, identified by name and registration number ... were documented as being displayed and distributed on DrTuber.com," the suit said.

    .........Kink.com, in a release, said it is asking in excess of $10 million in the suit filed today. The suit names DrTuber.com and Igor Kovalchuk, as well as Extron Worldwide Corp. and Era Technologies Ltd.

    “We will not sit still while others illegally steal and profit from our work,” Kink.com founder and CEO Peter Acworth said in a statement. "We will protect our work, we will protect our brands, and we will certainly protect our affiliates.

    Clearly a very wise man. I am happy to see Kink jumping in on getting these illegal tubes closed. Also interesting as this is likely one of the first cases we have seen reported on GWW in regard to the straight side of the industry.

    Ah, I see ... you mean that a program with straight sites is finally chasing down content thieves, which the gay programs have been doing for some time now.

    I think it is great that the big budget SFO studios are chasing after the Tube sites and winning multimillion dollar judgements. Titan and Ch1 and a 3rd won a collective case last week.

    It seams to me their legal costs are relatively low, using a calculated method for filing and winning the suits in US jurisdictions.

    Of course, judgements aren't always collected on. But winning them is a start, and getting their domain names is great as well.

    What is in my mind is that these same Tube sites poach videos from dozens, tens of dozens, of studios, so why don't these big budget SFO studios ask the rest of us to be Amicus?

    And if the big budget studios then actually collect $10 million in actual cash, give the rest of us Amicus a couple of thousand each - to make whole our exposure in all of this?

    We all were harmed. If the big budget studios win, would it be some kind of double jeopardy if some pretty Attorney then rounded up a list of the rest of us studios, and filed a similar suit against the same Tube, with us as Plaintiffs?

    Would there be any cash left? IF the sites went to the winners of the first judgement, and they continued to operate them because of the existing traffic, and monetized that traffic in the future, would we studios continue to be promoted on the tubes, and could share in the future revenue?

    I think we small studios are getting trounced on twice in all of this. First by the Tubes illegally selling our videos to their subscribers, then by a couple of big budget studios who are taking the ill-gotten booty as theirs.
