Australia Convicts 'Internet Pornographer'

The conviction of an Auckland webmaster charged with a range of internet pornography charges, has reinforced the Department of Internal Affairs view that internet offending is committed by real people in real places and not in "cyberspace".


Philip Carlton Batty, 33, was sentenced yesterday by Judge Thomas Everitt, in Auckland District Court.

He was ordered to pay fines and costs totalling $6440 and to do 100 hours community work on 22 charges relating to possession and distribution of videos and pictures of children being sexually abused, women being raped and bestiality.

The Department's censorship compliance manager Steve O'Brien said that part of Batty's defence had been that the website he administered from Auckland was based in the United States and, therefore, New Zealand courts had no jurisdiction.

Judge Everitt disagreed strongly with Batty's argument, stating in his written judgment: "It is contrary to common sense and the intention of Parliament that a person such as Mr Batty can escape the court's jurisdiction merely by using a server in an overseas country. "

Mr O'Brien said that Judge Everitt's decision strengthens New Zealand's censorship law, helping it meet the challenges of the internet.

"We are catching a steady flow of offenders - this was our third case to be sentenced in a week and the courts have shown that they will not let offenders hide behind spurious arguments about cyberspace or 'where is the internet?'."

Anyone else find it disturbing that this guy who was selling CP, *********** and Rape movies got put in the 'internet pornographer' group? :(

Why dont these people realize that 99% of us have nothing to do with that type of content?

I'm more upset that he only got 100 hours of community service and a small fine for CP. The penalty should be much steeper!

If that happened here in the UK the fucker would be locked up and beaten the crap out of by the inmates.

I agree, depending on the circumstances. The story doesn't give much detail but there's a good possibility he got off easy and notice how the law was bent to get even this small conviction? New Zealand has TONS of porn sites and prostitution is legal there, just like it is here in Australia.

I think this story is more about them going above and beyond to prosecute a CP webmaster then just your average porn site webmaster. At least they're doing SOMETHING because New Zealand has been nutorious in the past for doing nothing in regards to this kind of offence. :thumbsup:

I presume the *********** case didnt involve a sheep and thats why the dude got convicted LOL ;)

I did read soemewhere in the last couple of months that NZ seemed to have some rather lapse laws so far as prosecuting CP/Beasty/Rape type sites though so you may be right Squirt, this could well be a 'look we won' type scenario :)

Here's an amazing followup on this story... the guy was only an affiliate promoting these sites ( still scum I know but...)

"Batty operated a free United States-based website which featured videos and pictures obtained from some 50 websites to which he provided links.

He operated from his Auckland home and enticed people to pay to join those websites, which paid him a share of the subscriptions.

Batty told Department of Internal Affairs inspectors that for two years he had received at least $2000 a month in commissions.

He had faced prison sentences of up to one year on each of four distribution charges and fines of up to $2000 on each of 18 possession charges"

It just goes to show that affiliates are seen as equal to webmasters when it comes to content promotion, at least as far as this court was concerned.

Oh geez, that's not good! He was just promoting sponsor sites? What sponsor programs have CP, rape and bestiality??? Either they ramrodded this guy or there are some pretty fucked up affiliate programs out there.

when i first started a few years ago I came across one site and i swer it scarred be for life http://beastpass.com/ it is gross...

Other than that one I have never come across any others... or amybe i'm just not looking in the right places :wacko:

Surely there aren't alot left after all the clampdowns within the adult webmaster communities and the world governments alike?
