So TopBucks has a 2257 database for affiliates who use their content?

As of right now I'm only going to use sponsor content and I'm reading on the TopBucks site that they have a special phone number when you use their content.
And if youre under investigation for content that you got from topbucks then you can call this number and they'll provide the 2257 information for you.

Anyone see any flaws with this, or does this sound good to you all?
To me it sounds great, I can use their stuff on tgp gals, freesites and avs sites and can go to town promoting something, and if anything gets under investigation its all their responsibility to maintain and get me the id's.

personally if your this worried, id test them. how do you know they have everything required. also i dont think you should be this worried. do you have photo id on your hard drive (and backed up of course) to proove that all your porn models were over 18? if not why not? if yes then chill, your sorted.

is that wrong? is there anything else required?

this law isnt meant to scare you (actually it probably is with bush but hey.. hes a twat). the law should target peodos. if your acting within the law then dont let this scare you, just make sure you are 100% legal.

Sponsors arent going to give out the photo ids of all their models to every tom dick and harry affiliate.

then how can you be certain they have the required info? if your buying your own content u know if your legal or not.

-TopBucks ID & Password
-Verification of Payable to Address
-Full name and accreditations of 2257 investigator
-The URL of the image or video in question

I know you cant go into specifics, but overall did anyone contact you about your content he was using?
Were you available to support that webmaster who was using your content?

i wouldn't use sponsor content in this circumstance. the fbi won't be very gracious of the sponsor doesn't answer the phone or there is a server problem so you can't get to the i.d.

i would not want to be playing russian roulette in trying to get the people on th ephone while you have a team of FBI agents starting you down in the room. what about time differnces? we have heard soem inspections starting at 8am. is the phone manned 24/7

while i fully understand the relutance to give out ids to anyone, I believ retracted id's are still acceptable.

In a letter to the FSC, the attorney representing the Justice Department did directly say that redacted IDs were acceptable. However, the judge also admonished the justice dept attorney saying that he (the judge) didn't belive that the attorney was authorized to speak for the justice department on some of those issues... so who knows what is or is not acceptable with regard to those issues...

I don't believe they were looking at secondary very much with Mr. Sloan. They appear to have asked him about them, he told them he was a secondary, he showed them his licensing agreements, and that was it. They did not ask him to prove the ID's on the secondary models.

So unless TopBucks is called...how can they be in the know that a webmaster needs support?

The newly enacted law requires the "producer" to keep physical copies of all documents at their record keeping location. Online records or access to online records are not good enough. You must have physical control of the documents.

The new law does away with the terms primary and secondary, so it no longer matters which one you are. If you have editorial control of the content on your site and it comes from your server you are now defined as a "producer" and are liable for the full record keeping requirtements of the law.

So if you buy content from someone you had better get full copies of the models IDs, access to records alone is not acceptable. You must keep physical copies of the records at your location.

When in doubt, get an attorney! ;-)

We were never contacted regarding Sebastian Sloane. Yes we are available for contact on the phone if an inspector has questions regarding any of our models. We are all 2257 compliant.
