WOW - Feds Want Federal Porn Register

August 19, 2007 -- Ron Jeremy, Jenna Jameson - get ready to stand and be counted.

The Department of Justice wants to come up with an official list of every porn star in America - and slap stiff penalties on producers who don't cooperate.

The new rules, proposed under the Adam Walsh Child Safety and Protection Act, would require blue-movie makers to keep photos, stage names, professional names, maiden names, aliases, nicknames and ages on file for the inspection of the department's Child Exploitation and Obscenity Section.

"The identity of every performer is critical to determining and ensuring that no performer is a minor," according to the new proposal.

The adult film industry plans to challenge the new rule as a violation of the First Amendment, said Paul Cambria, a lawyer for Hustler and other adult film companies.

He sees it as a way to harass legitimate stag-film producers.

"If they can't get you for obscenity, they'll get you for violating record-keeping," he said. Such a violation would carry a five-year penalty.

The proposed rule would require porn producers to give the title of the video or magazine, or the Web address where the actor appears.

The Department of Justice has shown some sensitivity for the performers' privacy, however. All information not essential to proving their age and identity, like phone numbers and addresses, can be withheld.

Distributors of foreign pornography aren't off the hook - they must still produce a copy of the foreign actor's identification card. The department estimates that there are 500,000 Web sites, 200 DVD producers and 5,000 businesses nationwide that would be subject to the new rule.

The department did not respond to requests for comment, but in its proposal suggested that the benefits outweighed any negative impact on the porn industry.

"The benefit of the rule is that children will be better protected from exploitation in the production of visual depictions of sexually explicit conduct by ensuring that only those who are at least 18 years of age perform in such depictions. The costs to the industry include slightly higher record-keeping costs," the agency argued.

The feds really need to figure out the fact that the legitimate adult entertainment industry isn't the source of all the CP that's out there. The kind of person that is going to run around willfully breaking the law isn't the kind of person that would be affected by any of these laws anyways. It's the whacko filming their kids in the basement that creates almost all the CP out there and I seriously doubt 2257 or any other law is going to do anything to stop them.

Right and with bumfuck places like Arkansas creating laws that allow 1yr olds to legally marry with their parents permission they really need to look at themselves before blaming this sort of shit on legal pornographers.

And it's not like the U.S. is responsible for most of the CP. This is just another reason all legitimate U.S. porn companies will just totally ditch America and take all of their business overseas. All U.S. porn performers will be out of work.

Um, does anyone notice that this isn't anything new at all, just the already passed 4472 which updates 2257?

NY Post makes it sound like this is a radical new idea, but in reality, what they are mentioning in the article is the same recordkeeping that's been required of adult webmasters for 17 years.

I'm near certain that's incompetent reporting by the Post. Nowhere in 2257A/4472 does it say anything about such a national registry. Not that they might not try, but as far as I know, a bill hasn't even been authored that would provide for a registry.

Good .. let them foot the cost of building and maintaining a data base. I've said it for a long time. Set it up like the DMV & ID# all the actors. It works in mainstream film and stage theatre.

First, you'd have to set up a licence bureau for primary producers.

GREAT idea.

Complete agreement.

We found that there is a national registry that employers can access to check if employees are legally able to work, run by the Immigrations department. We were going to sign up to use it as a means of verifying age/citizenship, but there were 1,000,000 restrictions, all sorts of threats for penalties for not keeping perfect records, agreement to let the Feds check your records at any time, and -- best of all -- it prohibited using the database to check for independent contractors.

So the technology and solution already exists, but can't be used by adult producers.

I see Ron Jeremy talking about it, but I would still like to see where this actual proposal, law, regulation or whatever actually exists. Nobody can cite anything that references back to federal or state government. They are all quoting somebody, rather than a statute or law or proposed regulation.

Honestly, I think this is the most sensible idea I've heard yet with regard to adult content production. If there *was* a federal agency where you could verify a model's age, it would go a long way toward eliminating underaged performers, and potentially would make recordkeeping and crossreferencing a snap, particularly if there were a standard that Justice published that software developers could conform to in ensuring that the data was stored in an appropriate manner.
