Now if we can get rid of the Pro and Wannabee Tube sites from giving away porn, we'll all sleep a bit easier.

The problem is, without knowing what content of Pink Visuals was uploaded, nobody can really comment one way or the other in this matter, especially given the fact that a LOT of the Pink Visual DVD content can be legally licensed for online use.

Yes, and that is an issue several of us have been bringing up here, when someone yells "Stolen Content" on a site, and it turns out to be just another webmaster blog or traffic site, with affiliate links back to the sponsor.

But this one is interesting because of the tax case.

The big game changer here is going to be when Pink Visual can prove that the tube sites are uploading content themselves, its not all coming from the users. That fact alone takes them out of the context of a "service provider" and puts them into the role of running the site. Big, big difference from a legal perspective.

You can't say "I'm a Service provider and am protected by the DMCA", while at the same time uploading content yourself onto the site. That changes the game completely.

And more power to Pink Visual and Titan for using their resources to deal with the wild west attitude of Tube sites and others who steal.
