Actually, sending a letter to the domain registrar won't really accomplish anything; it would seem that your attorney is unfamiliar with the specific procedure, the Uniform Domain-Name Dispute-Resolution Policy, established by ICANN to resolves issues like this. WIPO is, I think, the most well known dispute resolution provider, and their website is here:

I'd read (or get an attorney that's familiar with the specifics of domain disputes based on bad faith and unlawful appropriation of a trade name to do so) the UDRP in the link at the top, and f you feel like your situation fits (which I think it probably does), file a dispute with WIPO.
Most likely, the guy who owns the name won't want to spend the time/money to fight, and will just give up the domain.
