Max, you might not think a state you never visited cannot charge you and issue a warrant, but you are wrong. If your content is viewed in Tennessee, the local prosecutor can present the evidence to a grand jury, indict you and have a warrant issued. All of this can be done without your knowledge and you have no right to present your side of the case to the grand jury--only the prosecutor can be in the grand jury room.Quote:

An obscenity case if going to cost at minimum $50,000 to initially defend, and if it goes to trial it's going to cost $200,000+. I know that first ammendment lawyers like Sirkin are going to want $50,000 retainer just to take the case!
As with most legal cases, it's not about whose right, it's about who has the most money to fight the battle. Sad, but true.

I forgot to get into those pesky details.
While that sounds like a shitload of money, there is a lot of time and effort that goes into litigating or defending a case. Depositions--interviewing witnesses and investigators _before_ the trial, takes several days by itself. A simple trial can take 2 weeks, and a trial lawyer needs to pay for the secretary, the researcher, the office and library, and possibly the private investigator.
It takes a good team a lot of long days to prepare a good defense. Without a good defense, right or wrong, you can go to jail. Chris Wilson, who had the site with the dead Iraqis and crappy surfer-submitted amateur porn, plead out his case and had to get out of the business instead of going to trial. The owner of Goalie Entertainment took a plea and went to jail. However, he got nailed on tax violations, which is why I always hammer on keeping the taxes paid and not fucking around with the IRS.
This is a business where the powers that be want to eliminate you. If you run a good business, follow the rules, pay your taxes, and pay a lawyer BEFORE you get into trouble, you can make a good living. If you push the envelope, break rules, and start asking about a good adult lawyer after deputy sheriffs have executed a search warrant and seized your equimpent, you are probably going to have several really bad years ahead.

Okay, Chad. Your post reminded me of a story. Heh heh. MaxPower, you may want to skip this.
I was at a dungeon party in Hollywood one time and I really had to take a whiz, so my friend said, "oh, they have a piss pig in the pit, just under that grate over there. So I go over to the great and look down and there's this guy in head to toe rubber, just sort of hanging out there waiting to get pissed on. Now, keep in mind, I was still really new at this time so I figured what the hell, started to unzip my fly and when I look down again he's waving at me. So I look a little closer and it turns out that he was a good friend of mine. So I wave back... then took a moment to think... and then decided that I couldn't bring myself to pee on my friend.
Looking back on this I have to laugh. I supposed pissing on a complete stranger would have been okay, but not on a friend? LOL!!! Of couse if that were to happen today I'd go right ahead and pee. I mean, that's why he was down there, right?
