It's a fine line between fantasy/fiction when it comes to what people find hot. I myself like a good rape fantasy--but I would NEVER want to get raped myself. The question becomes: How much of someone's fantasy do you feed before it becomes dangerous?
This is a question that has plagued (or not plagued) porn producers since the beginning of time. It applies to fetishistic content of all types, including bareback content, and also begs the question: Just how much responsibility do porn producers have when it comes to producing content for their respective markets? Should they be filming content that ONLY presents politically correct, gay activist-approved versions of consensual activity between adults, or should they be giving the people what they want?
Unfortunately, I don't think this is a question that can ever be answered, except by the person who is producing the content. Personally, when I write erotic stories, I like to indulge the fantasy, but I have my boundaries that I won't step over. Most of my stories are about sexual awakening and discovery, and they always end up being very positive and, I think, enforce healthy ideals about sexual exploration and identity acceptance. But someone else could read it and think, "Well, this reinforces such and such notion about such and such topic."
In the end, it boils down to, as you say, legality. If it's legal, it's legal, and if someone doesn't like it, well... they have the option of A) not reading/watching it, or B) creating their own content to counterbalance it.
