I am curious, operating outside of the USA in all respects, how is this going to impact me and other non USA sites?
Also, for the content providers most seem to alredy provide the necessary 2257 info, but its the free content & banners that really becomes the issue, least in my mind.
I use free galleries, pics from topbucks, pridebucks and aebn so what do I have to do to insure compliance?

gaystoryman - the new law says that SECONDARY PROVIDERS (us webmasters) have to have the i.d. and each url that the pics from that i.d. go to - so now it's not just the providers.
is the server your business is in in the u.s. or your corporation? it could affect you at some point...

Also, if you read the proposed laws, you will see that the current 2257 info on your site is worthless. You will have to be able to specifically identify the model, their real name, and where you obtained the photo (primary producer. this is a very broad sweeping law for us.
this law is due to happen or not before the election... so bush being elected or not will not affect it. it's time we all went through all our pages and started making notes regarding i.d. and place of purchase or producer for every url.
I'm just wondering if this is going to result in pictures of models holding up their driver's licences being available to anyone and everyone online.
If so, how are the models going to feel about everyone knowing their real name, their state/province of residence, and even their driver's licence number.
Seems to me that if it's going to be that wide open, we'll all face difficulty in getting people to pose for content.

The reality is there are those surfers who sign up for accounts just to get free content or sign up for programs only to use their own link to sign up for the website - in fact reducing their cost by the price of that programs payout so those of using proving free content if we have to provide this information are opening up the models to stalking etc as has been mentioned before in this thread.
At the very least, one thing we can do is password protect the free content until we have had a chance to review the url supplied by webmasters at sign-up to verify they in fact have some sites up...perhaps like tgp's who offer partner accounts, we'll need to see several url's. of course there are those out there who could easily put up a few galleries just to fool us, but it may stem the tide a bit.
The bottom line is yes, it very likely to make getting models more difficult which is already quite a task in and of itself...to say nothing of what it can do for the webmaster once that content is shot.
i have been getting i.d. from various content producers for years now. one of the terms and conditions - and it should be bold - is that you CAN NOT use the model's real name or i.d. anywhere on your website.
i would not only password protect that stuff, i would talk to each webmaster and make sure they understand they can NOT use the models' real information in any circumstances. i mean talk on the phone - if they don't seem to understand, sorry - no content!
at the risk of being unloved, i'd like to point out that models who are that nervous about their real name getting out should maybe not model. we have a girl we've been shooting for years. she was beginning to approach pornstardom - then someone emailed her family - she was devestated.
if having your real name out there will ruin your life, having your face out there will, too. my partner has sent away every model with this kind of issues.
one agent sent us a girl who will never be able to return to her home village - she would risk being stoned (i'm not kidding!) and no man would ever marry her there, which is essential for a woman being part of their community.
a lot of guys the agent sent who were nervous about their name getting out there are in school to become doctors or lawyers, but the truth is - as soon as it's found they modeled, they will be unlicensed. even real estate agents here have to hold a moral code.
i'm a lot older than those models, and i know what the consequences could be. we always tell them.
Bass chick...No offense but your last comment is ludicrous. Yes! they should be protected from having to give out their real name. If the content provider is worth anything (And you or any one else as a webmaster you should only be dealing with credible content producers who can supply you with correct model information.)
Do you really realise the ramifications of finding men to do gay porn if there real name is used? You are talking about an industry with very little content. Being a content producer I would venture to say that 80% or more of models would not pose if their real name was exposed. It just will not work.
And also as webmaster who shoots all of his own exclusive content I can not even begin to tell you how many emails I get asking for models information! "I am his biggest fan! Do you ahve any way for me to get ahold of him?" It's insane and scary. Some have even go so far as to pose as photographers trying to get information. Believe me I cannot even begin to explain to you what the ramifications could be for some of these models if their addresses and real names were to fall into the wrong hands
Imagine the google searches alone if this were to happen....Talk about the lawsuits when a freak shows up at some models house and guns the poor guy down. Imagine the lawsuit if the parents get ahold of the information that the stalker got all the information from your website?
I really do not think this law will go into affect in its current form. I can only imagine the lawsuits against the government if people get harrased, molested, or killed because of a law that makes their information public.
I believe in 100% protection and I would not give you or anyone else any information that is entrusted to me.

And not that information itself being on the site.
The proposed law acknowledges the use and existence of aliases, pseudonyms, nicknames, etc and asks custodians of records to organized 2257 material that takes that in to account. But nowhere in my reading of it did it say anything about that information being made available on the website itself or to the general public.
Rather, the information need be retained and seperate from other documents and made available to investigators/authorities if demanded in hardcopy or digital form at a business location.
Location of records.
Any producer required by this part to maintain records shall make
such records available at the producer's place of business. Each record
shall be maintained for seven years from the date of creation or last
amendment or addition. If the producer ceases to carry on the business,
the records shall be maintained for five years thereafter. If the
producer produces the book, magazine, periodical, film, videotape,
computer-generated image, digital image, picture, or other matter
(including but not limited to Internet computer site or services) as
part of his control of or through his employment with an organization,
records shall be made available at the organization's place of
business. If the organization is dissolved, the individual who was
responsible for maintaining the records on behalf of the organization,
as described in Sec. 75.6(b), shall continue to maintain the records
for a period of five years after dissolution.
BDBionic - you are not mistaken. the i.d. is not to be on the site - our info is and we are to act as custodians of the records.
randy - you completely misunderstood what i was saying.
are you - like many models - under the strange impression that someone's father or mother won't recognize their son's FACE if he does porn? a spam could arrive from a website with a pic of their son, or their wife's co-worker could be surfing and see it and tell the wife. or the guy could end up on a box cover that gets sold at his local liquor store. he could end up in a gay phone sex ad in a non sex newspaper.
i'm not saying we should be free to use the models' real names - i AM saying that anyone whose life would be ruined by doing modeling, gay or straight, should not be doing modeling at all, whether their name is used or not. and even though i am not responsible for them, i tell every single model that these things could happen.
