What is a small claims case?

Is an attorney necessary?
No. Small claims court is considered a "peoples court" and a lawyer is not required. Clerk's Office personnel will provide you with the necessary forms for filing a small claims case.
Who can file a small claims case?
Any person(s) 18 years or older or any individual doing business as a company, may file a small claims case. Each person who is a party to the claim must appear at the Clerk's Office to sign the necessary paperwork in the presence of a deputy clerk, or the signatures must be notarized.

The fee to file is around $200. I'm sure it would cost less for IBill to pay you after you file suite, then it would for them to hire an attorney to show up in Florida small claims. And if they don't show up to the hearing you receive a default judgement and can proceed collecting your money, worst case scenario you pay $100 to the court to garnish the income of the losing party. You don't need an attorney. The county clerk helps you fill out every form, that is their job.
