2257 regulations reguarding TGP gallerys or content you dont own.

I think it's really dangerous to assume it's dead, even for the moment.

We have a ton of right wing loonies who want everyone praying to God before they go to work each day, having only male-female sex in the missionary position, and only for procreation, and banishing all porn forever. These fine folks will ensure that the powers-that-be have *something* to go after legal adult content with.

But to answer your question... yes, I do think a lot of webmasters are sticking their head in the sand and pretending that 2257 is dead. :)

I would agree with that.

But in all actuality those that think that are the ones that really have no idea what 2257 really is. One needs to keep in mind that 2257 is MUCH more than an id stuck in a filing cabinet. Actually, that's the easy part. All the cross references are what is a killer.

Hi im sorry to ask, but what is the 2257 law regarding dating sites?
Im putting together a dating site now and was going to have it totally non nude. But if theres an exclusion for dating sites Id like to know about it.

There is no language in the 2257 regs that would exclude dating sites. Or tube sites, for that matter.

A handful of dating or tube sites are making the claim that they are "ISPs" and have no control over the content or material displayed on their networks and are therefore exempt since they are simply infrastructure providers, but this argument would almost certainly fail if tested, since all of these sites do, in fact, exercise control, either by removing offensive/illegal images, reviewing images, videos, profiles, or other content either prior to or after it is posted, and other things that indicate a degree of control over the content.

There's no way, if I were a US-based company, I'd do a dating site or tube site without full 2257 docs.

i hope you've talked to a lawyer, not only regarding 2257 but other stuff. there are plenty of other issues facing dating sites.

No, but if I feature a bunch of shirtless guys who are clearly over 20 with their shorts on I cant imagine the US govt knocking on my door, when there are far far more explicit dating sites out there.

I didnt see a 2257 warning on AllAmericanGuys and my site would be exactly the same, except I have profiles for guys who want to meet.

I think what Patti is saying is... you're starting up a site that has a bunch of potential liability issues and other legal issues.

None of us are attorneys (except Chad.) So any advice we give you is the best advice we know... but it still isn't legal advice and is worth every cent you paid for it :)

If it were me, starting up a new business, the last thing I'd do is rely on an Internet message board for legal advice for a new business... particularly given the area you're going into, I'd want to bulletproof myself, since there are so many different areas of potential civil and crimimal liability.

thanks to the news, i know that several dating services ended up in expensive court situations after people who met on their service were raped or harmed in other ways and tried to sue for damages or to shut them down. i know that if a minor signs up for your service using their parent's credit card - or even worse, their own - and has sex with one of your users, it can fall back on you. i know that people using a dating service system can receiving threatening emails that can result in court or worse.

a lawyer - a really good lawyer - is needed to write the disclaimers, to explain what kind of special insurance is needed, to tell you the things to avoid.

and non nude does fine, btw. i promote several non nude sites in various niches - the right ones, like nn fetish sites, sell just great. feet, latex and rubber attire, etc, are good areas to test.

Im very suprised by that. How in the world can a web site be held liable by what it's users do?

Then no one can have a dating site, and no one can have a messageboard either, because a member might flip out and you cant control them,

A remember less than a year ago a nanny was killed by responding to a job ad on Craigslist and Craigslist can't be held responsible for it because they just list ads.
CL also offers romance and sex listings. I dont see the difference between what Craigslist does, and running a dating site. So I dont see how they can be exempt but not all dating sites.
