If you see child porn and don't want your name on the report

I had a client contact me tonight and directed me to a website that had some very young looking nude models--so young they didn't even have pubic hair. The client wanted it reported to the ASCAP http://www.asacp.org/index.php but was not ready to put his name on the report. The ASCAP does take anonymous reports, but it was my experience as a prosecutor that reports from someone willing to give their name were taken more seriously. I submitted a report to the ASCAP and even left my phone number--I have had death threats from very seriously pissed off very bad people I had to send to prison so earning the wrath of an unscrupulous webmaster that puts that shit up is not enough to scare me.

If you ever see something that looks like child pornography but you don't want your name on the report, contact me through www.chadknowslaw.com or cbelville@azbar.org and I will be more than happy to submit a report and put my name to it.

A very generous offer however, i cant help but think that by 'transmitting' the link to the site in question over the internet to you so you can report it could get the person who found the CP in the first place in to more trouble than simply submitting the report to ASACP in their name.

Lets not forget, transmitting CP (including links containing CP) across the internet is a felony.

I know id much rather submit a site to ASACP myself and at least have some kind of proof that if i did inadvertently stumble across CP, that i wasnt looking for it and i did the right thing after finding it and submitted it to ASACP.

Just a thought, still a class offer though :thumbsup:

Chad - how can you tell when it's real CP, or when it's entrapment porn?

Some of the CP I've had arrive in my mail box is so professionally done that its hard to believe that this is being done by CP people - it looks too good.

I dont want this sh!t on my hard drive, and accidently downloading it makes me a suspect!

I submitted a few sites before but I never received any confirmations or anything. Do you only hear something they were successful in taking it down?

Thank you kindly for the offer - I use my alias when I report CP sites

I like to submit questionable sites to various anti-CP organizations ... just to make sure.

Valid point, but luckily there is a safe harbor rule for child porn. If you possess CP for the purpose of reporting it, at least under US law, then you are not guilty of possession. However, if you do come across suspected CP then the best thing to do is report the links immediately. Also, I will advise anyone on what to do if they find suspected CP at no cost. I no longer take on criminal defense cases [or divorces, or collections, or anything else that really doesnt have to do with adult entertainment] so I am not offering free legal work--but if anyone finds something that looks like CP, hit me up and I can walk you through it.

Just curious - possessing it for the purpose of reporting it, how do you (the person who has it), well can it be proven that you were reporting it and not "using it"?

I have one client now that I have reported for child porn actually. He was reported to us by 2Checkout actually. He set up a website to sell nutritional items. He was actually selling CP thru those channels

Also, I am sure that transmitting a link to an active member of the National District Attorneys Association [me] will not be considered to be anything other than reporting. If that is not enough to make you feel secure in reporting through me, consider that communications to me are confidential under attorney/client privilege and cannot be collected or used as evidence. There are no worries in sending me links to suspected sites--I want to see all suspected CP reported so I want to make it as easy and anonymous as possible.

Also, just curious, does that go for anyone? I mean, I have had a few people from other boards ask about reporting it. Is it possible to refer them to you or would that be too much?

It must be proven that you were using it and not reporting it--not the other way around.
Here are some points I would consider before filing charges:
How many images are stored?
How many times did the suspect visit CP sites?
What actions did the suspect take after viewing the sites?

So, if you get a piece of spam, click on the link and see it is CP, then you send me an email with the link or you report the site right away, you are not in any danger of being charged with CP possession. However, if you decided to "gather evidence" by visiting the CP site 8 times a day and downloading 1000 images, and then decided to "report" it 3 months later, well, in legal terms I would say you are fucked.

Thanks - we actually had this conversation in another forum a few months ago and of course no one really could answer it. So basically innocent until proven guilty on this? I mean, I know that is our judicial system but there are somethings that are a bit too scary.

I also sent you an email as well - once that has been reported but the masked site is still up. The client was from Russia so I am not certain if anything can be done about it.

He has been bad-mouthing me on a few websites because all the merchant accounts we set him up with have been terminated. Of course, I have not stated anything about why because I do not want to break our confidenitiality with personal finances / records.

And thanks - I'll let them know.

Great move ... I would personally report it too ... I don't really see what could possibly happen
