Bio Info for Models?

I was just wondering while I am writhing all this bio crap what people really want to know? I mean most of this stuff people can see in the pics, and not sure if I should lie about their general location “Country or if in US state” or even give it out, its not just the models anonymity I worry about, its that alot of them are not really in the US and I know that does not play that well in this market.

Should I Lie?

What if I do not know the stage name should I use their real name or make one up?

What Info would you like to know about a guy?

I know I am on his ignore list, but to anyone thinking of using a real names based on an ID you have, please don't. And many content providers in the license you get specifically state that you can not.

Any names that you may decide to use, need to be cross-reverenced with the models real name and ID for 2257 purposes.

So you are saying I should give their real first name, that is really weird I was more thinking it would be best to use a stage name or fake name like that model guy that is around here sometimes, I am pretty sure that is not his real name. No that isnt what im saying.

Im saying 'whatever' name you decide to use, you have to be able to correctly identify the models real name and age, hence, why the name you choose needs to be cross-referenced with the models real name and ID you have on file.

Its on a 'per name' basis.

If you give a single model 20 'stage names' you need docs on hand for all 20 of those stage names, cross referenced with each other.

Oh ok I think I got you man, it just has to do with my personal filing and storage so if the ask for so and so info I can find it easy. But you do think I should give them some kind of stage name, of course I would try to stick to the same name it would blow the illusion

Get an attorney fluent with 2257.

When do the site needs to have that 2257 disclaimer?

if the site is

hosted in the US?
owned by someone living in the US?
owned by someone outside US / Canada and targeting US / CA?
accepting sales from someone living in the US?
using a US based biller?
accepting sales from a US based customer?

The US Department of Justice is of the mindset that if you sell to US customers, you need to comply with US law. I can actually understand their reasoning in this matter in that if you sell anything in any particular country that item you sell there has to comply with local laws. If you are selling sexually explicit content or motorcycles or bottled water, when it is sold in a particular country it should comply with local laws. Selling through the Internet is just a relatively new and different animal because there is really no way to put internet content through customs.

For those that believe they are outside the reach of US laws, be aware that 2257 is part of a child pornography statute. By treaty there is cross-border enforcement of child pornography statutes so theoretically the DOJ can reach an offshore entity in two ways --first that the product was sold to a US citizen thus availing the seller of US laws and second that by treaty child pornography statutes have a global reach. Realistically there is little chance of enforcement of 2257 against a non-US entity but it could be done in theory.

I believe that if you are a US entity or selling to US customers, you are theoretically responsible to comply with US law, including 18 USC 2257. I don't believe hosting or billing is enough to establish a nexus, but if you are hosted by a US company or billing through a US biller then most likely you are selling to US end-users anyway.

That’s just grate what now? I can really not afford a attorney right now I know I will need one to look at all this crap. Can I not call a guy Billy if his real name is Ivan, or if a guy lives in Russia say he really in the US just to keep the illusion of the site going personally, I would think its better for the guys for me to indulge their Bios a bit? What could be wrong with that? Its not like I would say they are 15 when they are really 19 all this crap just gives me a headache :cry:

I see nothing in that that says I can not call them what I want in my sites Bios, that is about record keeping I do not have a problem with that. Really what can they do if I have the real info on the guys and say their names are all BOB and from Texas in the Bios? Has anyone ever got in trouble for that in the real world?

Max, you really need to do some research and pay a lawyer to help you. Sound legal advice is just as much a cost of working in this business as buying content. Advice from chatboards by armchair lawyers can not only be wrong but get you into serious trouble. There are several attorneys in California that can help you and it will be money well spent.

I know I will have to go back and do that man, and I will but right now I have to do the best I can. As I take I am back where I started with making up the names or using given stage names in the Bios. Personally I think this is all bit petty, people in my site are for lack of a better word actors and I should be able to call their role in my site by any name I want too just like on TV.

I watch TV too-- ever see "COPS"? Lots of guys getting caught doing dumb things and going to jail.

Those TV shows you are watching have releases from the actors to do what they do and use those stage names.

You can use any name for a model you want, IF you have permission from the producer and/or a model release that gives you that permission. If you don't know, then call the company you bought the content from. You are asking questions on a board that you need direct answers from your content provider AND you need to find an attorney that will review your website for compliance. It is a cost of doing business, and if you cannot afford it, you should not be in business. As Judge Smales said in Caddyshack "The world needs ditch diggers too"

OK I give Up I am just going to do what I want and keep the records, if one of my content provides has a problem with me using a fake name I want inside my members area when they do not provide one for me I will cross that bridge when I get their, and probably will not be to happy about something as petty coming from them, especially if they are rude or threatening about it.
