Miami Studios planning to (ONCE AGAIN) rip off an Eon Films movie

Hey everyone.

This word just came to me yesterday from a VERY reliable source that John Flanagan of Miami Studios is planning to cast and film a movie called "The Dicks of Hazzard" and to release it while my movie is still in Editing, BEFORE it is allowed to hit the market.

This is not a new tactic for Miami Studios. Many of you recall that he did the same thing with "Ashton's Eleven" when we filmed that. As soon as our movie was in editing, Flanagan had his movie filmed and out within a couple of weeks.

Now, I have no love lost for Flanagan. I have been very open about my dislike for him, his practices and his company. But I have never tried to steal a movie title from him or anyone else just to spite that person or to try and piggyback from their sales.

Needless to say, I own the trademark to "The Dicks of Hazzard", as well as thedicksofhazzard.com.

We are being distributed through White Tiger Releasing and have some very nice write-ups on our movies coming very shortly.

The first post in this forum regarding the name "The Dicks of Hazzard" as our next big movie announcement, complete with pictures of the models who appear in the movie in costume, was made on May 30th, 2006.

I find this action by Miami Studios to be beyond deplorable. I just wanted to let everyone know that "The Dicks of Hazzard" is undeniably an Eon Films production, and any knock-offs from a studio, especially Miami Studios, are not a form of flattery, but of greed and foul intentions to confuse the marketplace in order to handicap our sales.

if you make money with your titles and there is some sucker who constantly steals... do it with every movie you produce - here a TM costs as low as EUR300 - so, "peanuts" to your production costs I bet

My suggestion is to keep your productions top secret until you're ready to do a full marketing blitz. That even includes the title of the film. This is the porn industry after all. :rolleyes: Content is very easy to take and last minute trademark or copyright registration is not optimal.

Create a checklist for each concept you come up with before you start rolling the cameras. You'll always have your butt covered.

Trademark applications take anywhere from 12 to 24 months to process, usually about a year before the first examination of the application happens, and the us is a "first use" country. So if Flanagan actually has a real product that exists before you do, he can legitimately claim first use of the title and get the trademark.

*Filing* a registration for a trademark is nearly meaningless in the US. All it shows is that you have an application pending, not that you have any rights to that mark. The owner of Cobra attempted to file a trademark on "Brent Corrigan" a year ago almost and the application hasn't even been examined (first of many steps).

Sorry to be the bearer of bad news, but I agree with dwaynerd, the only way to have any sort of protection on is to be able to show use of the trademarked name in commerce over a period of time, and so your best bet is to not mention the title anywhere until it is actually shipping (or at least until the title actually exists and is available for sale.) I'm not a trademark specialist, but I don't think that marketing vaporware counts as "use".

Flanagan is the only person in the industry I can think of that I've never heard a *single* positive word about from anyone. It's sad that he feels the need to be so petty, but the truth is, if your product is better and distribution is decent, yours will win out in the market anyway.

It is sad they have to go around ripping off ideas after all they are a big company, I think it the are going to take a idea the Passion of the Christ one is what the should have done maybe even a bit of the Exorcist throw in like the scene with the cross and the girl on the bed would have been cool. :develish:

In Germany you have to prove that you used the TM in a busines manor (letters, claims in newspapers, something official). Forums do count here too.

I don't think Chad does much with intellectual property issues, but I could be wrong. Patent and trademark law is a subspecialty with a lot of nuances... I know because a company I worked for was involved in a trademark dispute a few years ago. It's a pain in the ass, and the USPTO moves with speed that can only be described as glacially slow.

US is a "first use in commerce" country as opposed to say Mexico which is a "first filer" country. But I am near certain that "use in commerce" doesn't mean ripping out a few ads and postings when you've heard that someone else is ripping your mark. My understanding is that it's similar to what you describe in Germany... printed matter advertising a product THAT EXISTS and isn't vaporware.

Honestly, this is definitely not a claim that would be worth litigating even if Rocky gets a trademark registration (which will be issued long after the title is back catalog and no one is interested any more... there's little long-term life for adult DVD titles...) The cost to litigate a trademark claim could easily be over $100,000, so it's a battle best fought in PR.

I actually started posting about this movie waaaaay back in April. The promo pics have been coming isnce May 30th. Posting abou tmy movie is nothing new, nor is it a knee jerk reaction to the news that some company was planning to release a movie with our title.

For those who know (JustMe is one of them), I have been planning this movie since October, when Josh Tucker and Jarett Fox were originally cast as Bo and Luke Dick. I wrote the script in March, started casting in April and did principal photography in May, which is how I had the box cover done and the promo images of each model, and I still have more of those coming.

So this movie has been in pre-produciton for a few months. It goes into full production at 9am, pst on Friday June 23rd, which is tomorrow.

I talked to the US Patent and Trademark Office about your earlier posts, and they agreed, yet they also said that once my application is processed (and it has been), then I can begin using the trademark symbol (a circle with a T)
on the movie after the title. Once it is approved, I can use the registered trademark symbol (a circle with an R). They also said that any company who tries to obtain a trademark after I applied needs to prove that they had rights to the title before we began to use it with an intent to use in commerce, which was in March, whcih we also have proof of. Miami Studios does not, nor does any other studio. I made sure that there was no way any other company could claim rights to the name before I completed my application (they required a copy of the box cover, which I had ready thanks to the photos I had already taken, as listed above).

So yeah... I had this shit a LOOOONG time ago. This isn't just me reacting to some rumor or bad news. I've been plannign this movie and getting it ready AND PROMOTING it for a long long time.

I've gone through the trademark game with the USPTO and it generally takes months and a great deal of money to get a trademark issued on a mark, much more difficult to get it issued on a name of a film, and very expensive.

Very few studios ever go to the trouble, time and expense of attempting to trademark a name of a film.

Perhaps he mean copyright, but then, a copyright cannot be applied for until the film is released to the public. At least, to the best of my knowledge.

My advice is to consult your counsel on this.

This problem is so rampant in this industry. I have addressed this very issue several times before.

In the end, the better product will stand on its own and the better product will bring back consumers - the bad product will not.

You Know Gerri, we started production of Our Parody of Bareback Mountain in 2005. Last week, according to at least one industry chart, our film was the # 1 hit in the country. I don't steal from anyone Gerri, certainly not you, as Honda does not steal From Kia.

In January of 2006 one of your own models sugested the title to us as the safe sex version of Bareback Mountain. It seemed cute and we ran with it.

You 'll be glad to know Gerri , that my 2257 records, governed by the advice laid down by our attorneys, Weston Garrou and De Witt et al, are quite acurate . Our scenes for this film begain shooting in January. Your own model alex cross, who stars in this movie , shot his scenes MONTHS ago. And there is no need to keep calling Jarett Fox. He is just another model you did not pay, (Are there is quite a number of those?) and he has no interest chatting with you. You can of course, send him the $550.00 you have owed him for months.


So Please, Stop trying to trash a company you so are obvioulsy jealous of. Please stop stealing MY titles , and pretending the reverse is true. The production dates and copyrights of the various ashton 11 films, says it all.

What does any of that have to do with you copying the Dicks Of Hazzard movie?

This thread isnt about Bareback Mountain, its about a concept that Rocky posted about that you, apparently decided to use after hearing what Rockys plans were.

From some of the discussions we've had on the GWW Community before about you guys, you certainly dont seem to have won many fans in the industry from your peers.

Well, well... the snake is out from under the rock. I have made my name in this business, JF. I have never hidden the fact that I did a movie for you and was topped by a black guy. Feel free to release it all you want.

As for stealing your titles... just because you can rush a production together in 5 minutes using old footage from movies that are X-years old, does not give you the rights to the intellectual property of said movie title. Our movies are higher end than yours, with a production time of 3 months. The true fact is that Ashton's Eleven was in production while in Las Vegas in January. It was in Post Production and Editing during the time you released your "version" (and I use that term as loosely as fuckin possible).

Why name your movie "Ashton's 11"? There is no model in the movie named "Ashton"... not a single one. There IS, however, a dog in the movie that is CALLED Ashton to serve some sort of lame plot device about the dog's birthday party. You named the movie "Ashton's 11" because you knew that Ashton Ryan worked for me and that we were filming a movie called "Ashton's Eleven", since one of YOUR models was in it. Credit to your dog, Marilyn, god rest her soul, who was the only thing I ever found redeeming about you.

But petty insults aside.

This new movie actually has a production date that supercedes your juvenile title by weeks, perhaps even months. I posted here that the production began on May 30th, 2006, when that was just the date I began posting pictures of the cast. The movie was fully cast on May 14th, and the production date, as well as the USPTO records were, and remain so, in my name, far, FAR in advance to that.

So please, feel free to release your little film. I am not the one who has so far stolen 2 movies from you, and I never will.

I would suggest that this is not the place to "air out the dirty laundry", and that if some of the wrongs have actually occured, then a court of law might be perhaps the place to take these issues.

These forums are better served to help webmasters to grow our businesses rather than tear each other apart.

If copyrights or trademarks have been violated....go to court. If models haven't been paid....take it to court.

As a wise old sage once said: "if you get into a pissing contest with a skunk, your're going to lose, even if you kill the skunk". None of us in these forums know who the skunk is here, and I'd imagine that most of us don't really care so why don't we quit with accusations and move on to helping each other to better run our various businesses.

Hi guys, have been noticing what is going on... and though a title is a key selling point on a movie... its not the only thing... you have to think about the story behind the film, the models, the production value, and so on...

I have been in the industry for a short time, but have gathered a lot of knowledge about titles and films. In our system, we have numerous titles that duplicate themselves, but it really matters as to what in the film is true to the title and how much that producer spent on the film.

Though I haven't heard much on the other production, I have been hearing a lot of this production and from the amount of work that has been put into it, I think it will do well. I'm not really one for speed when it comes to putting a title out because the best parodies are ones that you can tell the producer put a lot of time into. If I recieve a title just because it is a parody, that won't be my only key point of promoting the title, but rather if it looks appealing to the customer.

Just some food for thought.

I don't like getting in the middle of other people's fights, but I really don't want to see GWW become like a certain other board where name calling and reputation bashing become the norm.

Rocky has been a very active person on these boards and usually does a good job of being courteous to those around here.

I know both of you are angry, but if you want to drag this whole issue out in public, keep your arguments about the issue and do not resort to name calling and cheap shots. That's not how we do business around here.

And, I've no doubt that you will be the winner. Just concentrate on making a good product.....and don't cheapen it by selling it for $39.99. If a studio is selling their products for $39.99, I suspect they know the value of their own products.

I wouldn't get all bent out of shape, your videos and the product you put out is much better then Miami Studios. Although Miami Studios has been in business much longer, your product will out last and out perform. Your version of "The Dicks Of Hazzards" is much better and it will be a HIT once its released!

As an individual and working with you as a professional, its a pleasure to deal with you and we are glad to have you onboard as part of our team at D&E Productions & White Tiger Releasing! Going forward a good practice is to keep your titles PRIVATE and not tell your models or make any rush announcements ( I learned that a year ago when another studio took one of my titles & ideas)...use a fake working title and once the video is ready to be released, then the real name and all the promotions begin. As for models/talent, be careful and don' tell them anything either.

As for this site, its not a great place to air dirty laundry...and we agree with Bill and the others. Get advice from your Attorney and see if you can take legal action, you might win the fight but loose the war!!! So it may not be worth it. You do great work, your very organized so do what you do best...film, produce and release DVD titles and ignore everyone else!
