When I consulted my attorney before starting out, he certainly made it clear to me that I shouldn't go anywhere near things like fisting, watersports, and simulated rape.Quote:

Unfortunately, there is no definition of what is and what is not "obscene" in the US laws. Simply a vague statement about "community standards". But I'm sure that horse has already been beaten to death on this forum (reminds me, *********** is a no no too, though I'm not sure exactly what type of person is into that sort of thing to begin with).
Dzinerbear turned me on to you guys. This is right up my... um... alley (so to speak) ;)
I've signed up already, but I have a problem with you FHG... I'm starting my own TGP and my script regects your sites for some reason. I have the submission rules set to very low standards, but the script give me a 302 error... it's not finding the gallery. My guess is that it has to do with the link codes redirecting.
Any insite, Pistol?

I believe fisting has already been tested in California, no?
If I remember correctly someone got sued over there hence why they say if thumb was not inserted it is Ok, sorta, but if the whole hand was in it was definitly considered obscene
Greetings:
Unfortunately, according to my attorney (keep in mind i'm no legal expert), "community standards" means just that, COMMUNITY. What may be illegal or legal in one state or even town, may end up being the opposite in another.Quote:

For example, a jury in San Francisco might very well say fisting isn't obscene and there's nothing wrong with it. Meanwhile, a jury in Saltlake City Utah might have an entirely different opinion of what constitutes obscene.
It's all a big legal cluster fucker, which is exactly why my attorney told me it's best to stay far far away. I have no desire to become a test case......
Nice work Brian. Should convert like crazy.
right about the community standarts, but i was just guesstimating that it's been tested before
i dont think it would be bad to promote it, just to own it ... maybe

Well hell, that means we're all up the creek without a paddle ... I'd hate to see what the community standards in Salt Lake City say about guys sucking cock.
Dzinerbear
the cambria list is supposedly a good reference what not to do
Lol... I'm sure even girls sucking cock is against Salt Lake City community standards.Quote:

Have you ever actually read the cambria list? It includes things such as "male/male penetration" and "bisexual sex".Quote:

Certainly not something that the gay community of webmasters can turn to as a list of standards. None of us would have websites...
Personally, I think the more appropriate course of action is to simply avoid the extremes, including things like watersports and fisting.
It a risk vs. reward decision that each webmaster has to make for himself/herself. Personally, I am not in the risk taking business. I think we can all agree, that if Bush gets reelected, that risk will only be greater. I'd sooner not invest my time and money into a venture that would obviously be out in the front and center should the attacks start....
Pistol, can you look into this, please?Quote:

yeah i have seen it Paul Cambria is one of the best attorneys out there.
I agree most things on the list are crazy, but it's things that would be deemed obscene in any forsaken backwards community with "standarts"
Even Playboy can be deemed obscene at some places
Hey xstr8guy - We use the MPA2 affiliate automation system and have experienced this problem before. We're working on it now and will let you know when it's been rectified.Quote:

Fisting IS an ambiguous subject - which is why at THIS TIME we are carrying it. Other subjects such as excrement, non-consensual sex or violence are undoubtedly considered to be obscene and are total no-go zones.Quote:

Should the legal situation with fisting change so will our attitude.
So my feelings - check out your local jurisdicational laws and make an informed decision. If you're concerned about the longevity of the product promote it under the per sign-up program so you won't lose out on long-term rev share should we need to pull it down.
Hope this helps.

I'm having the same problem with PrideBucks sites.Quote:

In respect of whether something can be deemed obscene or not, the courts have to apply something called 'The Miller Test' to any such cases which has specific guidelines which will determine whether or not somehting is obscene by local community standards and, that is where the problems lie with the current US obscenity laws.
If you live in Bumfuc Georgia for example, the community there may well have a different 'standard' of what is and isnt obscene as say the community in Las Vegas.
There is actually a post in the Articles + Tutorials forum that details more info on The Miller Test if anyone is interested in reading up on it some more :)

Lee
Here's the solution to the problem:Quote:

I'm having the same problem with PrideBucks sites.
http://gunzblazing.com/gallhit_wo_r.php
put a ? mark at the end and place after it the original links.
Here is an example:
http://gunzblazing.com/gallhit_wo_r....all=1087396802
That's all the one line btw - no break after ?
Let me know if you're still having problems.
sorry - it lost a line - here it is again:
http://gunzblazing.com/gallhit_wo_r.php?
http://gunzblazing.com/gallhit.php?w...all=1087396802
If you're still having problems hit me up on ICQ 169111106
I was told by PrideBucks that using the destination url would work also. Like this...
http://www.rearstable.com/galleries/...ce%2Findex.php
The board will make this look a lot shorter, but click the link and look at it in the url box.
OK cool - that was what we were told by Mansion Productions.
Choice is good!
Hey xtstr8guy - we tested the link that you mentioned and it doesn't work. I recommend using the one that is specified in my last posting.Quote:

Fisting definitely runs an obscenity legal risk in USA...I removed all fisting pics from my sites just to play it safe, but I am glad others are willing to run the risk of being prosecuted. Hard to believe that fisting and excrement fetish have legal obscenity risk, but simulated violence and murder in television and movies are fine and legal in USA no problemo!
