As the deadline for 18 USC 2257, 28 CFR 75 compliance approaches, PrideBucks would like affiliates to be aware of some new policies that may affect them. After lengthy discussions with our attorneys, we feel the new policies are the most appropriate means to both comply and still provide webmasters with ample tools to promote our family of sites.
Effective June 23, 2005, we will no longer be offering Hardcore banners, Hardcore downloadable TGP templates and Hardcore free content in PrideBucks Affiliate Central. We are adopting this policy because we have decided we will not distribute our model's documents to the masses, which at best would jeopardize their right to privacy if not their safety. Please note that we will continue to offer Hardcore Hosted Galleries and highly recommend their use.
"Hardcore" is defined as any picture which shows: an erect or flaccid penis, scrotum, anus, masturbation or sexually explicit conduct as defined in 28 CFR 75 including, but not limited to genital-genital, oral-genital, oral-anal, and anal-genital contact.
We are recommending that webmasters cease using PrideBucks Hardcore free content including Hardcore MPEGs and pictures and Hardcore banners, as well as Hardcore downloadable TGP templates. These tools will be removed from the marketing section and will be replaced with "Softcore" material. Of course, you may continue to use any existing Softcore tools already made available.
"Softcore" content includes: face, chest, buttocks (not the anus), pubic hair and simulated sex. For these purposes examples of simulated sex includes: kissing, hugging, nipple licking or other instances where the images do not include depictions of genital-genital, oral-genital, oral-anal or anal-genital contact as defined in 28 cfr 75.
So that there is no confusion, we would like to make clear that this policy affects only the marketing tools that PrideBucks provides. Affiliates may continue to use Hardcore content to promote our sites, which they have licensed and/or own the copyright.
The PrideBucks team is working diligently to provide our affiliates with compliant marketing materials. This policy should not be regarded as legal advice to our affiliates. Affiliates concerned about compliance should seek their own legal advice from their attorney.
On June 23, 2005 the PrideBucks terms of service will be changed to reflect this new policy. Please be aware that if an injunction is granted by the courts against enforcement of the new 28 cfr 75 regulations, we will adjust our policy to reflect our current legal understanding of the injunction. We will notify you again if this new policy is suspended as soon as possible.
