If you see child porn and don't want your name on the report

I had a client contact me tonight and directed me to a website that had some very young looking nude models--so young they didn't even have pubic hair. The client wanted it reported to the ASCAP http://www.asacp.org/index.php but was not ready to put his name on the report. The ASCAP does take anonymous reports, but it was my experience as a prosecutor that reports from someone willing to give their name were taken more seriously. I submitted a report to the ASCAP and even left my phone number--I have had death threats from very seriously pissed off very bad people I had to send to prison so earning the wrath of an unscrupulous webmaster that puts that shit up is not enough to scare me.

The only thing worse than child porn is child porn that goes unreported.

A very generous offer however, i cant help but think that by 'transmitting' the link to the site in question over the internet to you so you can report it could get the person who found the CP in the first place in to more trouble than simply submitting the report to ASACP in their name.

Lets not forget, transmitting CP (including links containing CP) across the internet is a felony.

I know id much rather submit a site to ASACP myself and at least have some kind of proof that if i did inadvertently stumble across CP, that i wasnt looking for it and i did the right thing after finding it and submitted it to ASACP.

Just a thought, still a class offer though :thumbsup:

Chad - how can you tell when it's real CP, or when it's entrapment porn?

Some of the CP I've had arrive in my mail box is so professionally done that its hard to believe that this is being done by CP people - it looks too good.

I dont want this sh!t on my hard drive, and accidently downloading it makes me a suspect!

Valid point, but luckily there is a safe harbor rule for child porn. If you possess CP for the purpose of reporting it, at least under US law, then you are not guilty of possession. However, if you do come across suspected CP then the best thing to do is report the links immediately. Also, I will advise anyone on what to do if they find suspected CP at no cost. I no longer take on criminal defense cases [or divorces, or collections, or anything else that really doesnt have to do with adult entertainment] so I am not offering free legal work--but if anyone finds something that looks like CP, hit me up and I can walk you through it.

Just curious - possessing it for the purpose of reporting it, how do you (the person who has it), well can it be proven that you were reporting it and not "using it"?

I have one client now that I have reported for child porn actually. He was reported to us by 2Checkout actually. He set up a website to sell nutritional items. He was actually selling CP thru those channels
