I beleive it is a federal law about selling used clothing, specifically underwear, thats also the reason most retail stores will not do refunds on underwear items.

You can probably find the specific section by searching on 'retail law' or something similar in Google

The only difference seems to be that they are individuals...

according to Naughty bids they require that the used underwear is washed first. or at least they make the sellers state that.
