SafeSurfers.org owner convicted of making & possessing CP, fomer cop *no jail time*

A former San Diego police officer convicted of making and possessing child pornography was placed on five years' probation yesterday and ordered to stop operating an Internet-safety Web site.

Brett Kenneth Hensley pleaded guilty in June to one felony count of using a minor in the making of child pornography and three misdemeanor counts of possessing child pornography.

Hensley, a 12-year veteran who resigned in June 2004, surrendered in court Jan. 18. A search warrant had been executed nearly a year earlier at his Sabre Springs home by U.S. Immigration and Customs Enforcement agents and San Diego police. Soon after he was taken into custody, he posted bond and was released.

During a San Diego Superior Court hearing yesterday, Judge Charles Rogers told Hensley he could be sent to jail for a year if he violates the terms of probation. Rogers ordered him to complete 30 days of public service. Hensley also will have to register as a sex offender for life.

Deputy District Attorney Geoff Allard argued unsuccessfully that Hensley should do some jail time – up to 240 days – for his crimes. A forensic review of Hensley's home and work computers revealed numerous images of child pornography and e-mail messages indicating he was communicating with female minors, according to court documents.

The agents also discovered that Hensley solicited phone sex with a teenage girl who lives out of state and requested that she e-mail him sexually explicit photos of herself. The girl believed she was communicating with a 16-year-old boy, the prosecutor said.

"Words really don't do justice to the defendant's crime. It's all really about the pictures," Allard told the judge.

Defense attorney Gerald Blank said in court that Hensley entered therapy soon after the search warrant was served and moved out of the house he shared with his wife and children.

"This is a gentleman who immediately responded to the problem," Blank said, adding that his client committed the crimes "in the darkest and most difficult days of his life."

Blank said the problem started when Hensley began downloading adult porn on the Internet at a time when he was having trouble in his marriage. Hensley never distributed child porn or tried to meet any minors in person, the attorney said.

Judge Rogers called the downloaded images "shocking," "disgusting" and "degrading," but said he believed the defendant was remorseful. The judge noted a report by an evaluator who said she didn't believe Hensley was a *********.

However, the judge ordered the defendant to stop operating a Web site – www.safersurfers.org – through which he offered tips to parents on ways to protect their children from Internet predators. Rogers gave Hensley 90 days to sell or transfer ownership of the site. FULL STORY

    ----

Do you think probation and losing the Safesurf.org site is a just sentence for the crime? Is blaming a bad marriage a good defense for making, possessing CP?

That just gives parents more reason NOT to use those types of sites / programs to block porn from childrens eyes.

I also cant help but wonder if he was using his own experiences to 'educate' these parents or if he was giving them information that could have potentially drawn children towards the predators

No, I think he should have served some jail time. But that's just my opinion.

i KNOW he should have served some jail time. when cops get busted, the judges generally seem to feel that losing their career as a cop somehow makes up for a year in jail - where a truly remorseful doctor or gas station attendant does that year.

whether it's robbery, rape, drunk driving or whatever - if a cop did it, he generally pays much lower fines and does much less time. what the fuck is up with that?

I think it's the same mentality they use when sentencing clergy... they are trying to make the world a better place and sacrificing so much.. so let's give them a break. I think it's ironic because a person victimized by a cop, a priest, a celebrity, or a janitor is victimized the same, the crime, pain, trauma, are the same for the victims.. that doesn't change. What do you think?

One of the girls told them he called her on the phone and also asked for nudes, which she sent. So they made her the victim and nailed him for the production of her CP since he is the one who asked her for it.

Sounds to me like that little slut should have been arrested too for producing her own CP and sending it out to anyone who asked for it.
I post here to whore this sig.

I think that people like that (a cop, a priest, a celebrity) should serve more time then a janitor because if you are a cop or a preist...the job comes with a certian level of trust, we were all raised to trust a cop and trust the preist and the bad ones make everyone else look bad (sound kinda firmiliar?) :honest:

I grew up catholic and was an alter boy, never molested...I think it's a pitty in the first place that priests are molesting children, and what's worse is the church covering it up. but that's another post. People with a level of trust and respect should get DOUBLE what a janitor would, because they knew better. They knew it was wrong and they did it anyway...put em under the effin' jail. people like that truly make me sick.:ill:

but let's not forget the root of the problem in the first place...underage kids, If their parents payed attention to what their children were doing in the first place none of this would even happen. he had to have talked with that girl on multiple occasions to get her to send him naked pics of herself, (unless she's just a total whore, then she'll make it big in this industry when she turns legal.) grrr..

josh, i totally agree. it should be an entirely additional set of charges to exploit children you have access to due to the privilege of being in a trusted position. i don't know about a celeb - to me, that's more complicated. i mean, just because someone becomes an actor or a singer doesn't doesn't mean that they have accepted the public's trust in the same way.

on the other hand, people do trust and love their celebs - but i'm not sure why. arnold being elected governor with no kind of political experience or appropriate knowledge regarding working with goverment funds is a good example of how people feel about their celebs. and even though, since he's been here, we've had a bunch of hospital emergency rooms closed, and money cut from everything arnold promised money to, there are still lots of people who will vote for him - just because he's famous :-/

and that's why i didn't touch that subject babe. Because we all know a celeb can commit a double murder and have an ocean of evidence against him and walk (coOJugh) In the case of Michael Jackson, we all know he molested those children, it just goes to show you that the justice system in this country gets just as star struck as the rest of us. It's a shame, lady justice is supposed to be blind, but apparently she watches TV.

OK, DO we know this about Michael Jackson? You don't think that b/cuz he's a celebrity, you are jumping to your OWN conclusions about his alleged guilt? Obviously, the guy has got some problems with appropriate behavior involving children, and I do think that he is in some serious need of therapy to work through his Peter Pan syndrome. But I don't know that he actually molested those kids. He may have shown them pornography, which is entirely inappropriate, but I don't know about the rest, so I reserve my judgment about the severity of his guilt. I definitely think there is something twisted going on over there, but it is very possible that, b/cuz he IS a celebrity, that he was an easy target for these kinds of allegations to be made about him.

My general rule of thumb: Unless you were there to witness it, don't make declarations of someone else's guilt. Benefit of the doubt is something that I feel should be observed more often.

Oh come on dude let's be real for just a sec. the kids described what his penis looked like the FIRST time all this shit happened. He slept in the same bed with them, he's in his 40's. When was the last time someone slept in the same bed as you and u didn't do anyting with them? and then have them be able to describe what your dick looked like. And don't u think he had a motive for showing them the porn in the first place, giving them alcahol. I dunno.. i may be wrong...but i really doubt it.

it's nice to know u feel the same way about the OJ thing tho

i don't believe anyone knows what happens in any situation unless they are there. michael jackson could have had an employee - a clothing designer or something - who could have described his dick. is it likely? no. is it possible? absolutely!

and josh, dahlink - please try HARD not to call me babe again

I called BassChick "FishWoman" once. She didn't like that one either.

Be careful, she's a former body builder, and can kick your ass. I learned that the hard way.
