LAKELAND, Fla. — After being released from jail at the end of December, Christopher Wilson, who is facing 301 obscenity charges for posting obscene photos on his website NowThatsFuckedUp.com, is back in business.
Attorney Lawrence Walters, defense counsel for Wilson, told XBiz that Wilson has restored all content to the site and feels safe in doing so.

“In light of recent developments in the case, we feel it is appropriate to put the content back on the website, which he has every right to under his 1st Amendment rights,” Walters said.

After his Oct. 7 arrest by Polk County sheriff's deputies, Wilson posted bail, moved to Orange County, Calif., and continued operating his website. But in December, Judge Dale Durrance revoked Wilson’s $151,000 bail and remanded him to custody at Polk County Jail, though all explicit material had been removed from his site by that time. Wilson was originally denied immediate release during December, before an appellate court granted his release on Dec. 29.

Walters said that law enforcement has stated they will continue to monitor the site, though he said he feels “it would be a mistake” for law enforcement or prosecutors to seek another bond revocation.

Chip Thullbery, a spokesman for the State Attorney's Office, said on Jan. 6 that "Law enforcement officials continue to review the website." However, he declined to state whether any new charges would be filed due to the website’s continued operation.

Wilson’s pre-trial conference is scheduled for Feb. 7, but a motion hearing for the case is scheduled in March, indicating that a change will have to be made. Walters said it’s possible the trial may be pushed back to a date after the hearing.

“There’s no telling how the case will proceed,” Walters said. “It’s kind of up in the air as to when things will happen.”

Defense counsel is currently seeking to remove Durrance from the case and has filed various motions including motions to suppress, dismiss and determine various aspects of the case.

Btw, this situation is just a political attack on Chris Wilson just because he gave free memberships to US soldiers in exchange for their gore pictures. Sure, the government wants to disguise it as an obscene pornography case but this is sheer censorship. It makes my stomach turn that our government can actually get away with these Nazi tactics.

no matter how much i wanted to make a political statement, i would have kept the porn and the politic statement on 2 different websites.

lawrence walters explained a reason to me why one should keep one's site up if some kind of legal thing happens. i don't feel comfortable quoting him here, but there is a solid reason - even beyond the fact that the stuff is legal and is mr. wilson's business.

Good point Patti! The display of dead bodies on a porn site is just plain gross and it discredits any political statement he would have made. I honestly don't think his intentions were noble... like fighting the censorship of this unnecessary war. But I'm going to defend his right to do it!

Wilson was charged with obscenity for mainstream porn--that should scare just about everybody. What they were REALLY trying to do is shut him down because he was making the government look bad because people really do die horrible awful deaths in war. Anyone that thinks we should all turn our eyes the other way really should take a peek at the films from WWII concentration camps where the civilians had turned their eyes the other way. Of course it is gross, but I commend Wilson for having the guts to put it up.
Then, they revoked his bond illegally. That should scare anyone who wasn't scared about the "charged with obscene material" bullshit in my first paragraph. The prosecution doesn't seem to be following the rules. Wilson should never had his bond revoked and should not have been charged in the first place. There seems to be a concerted effort to shut him down for publishing images that make the government look bad--as if there is a "this war cannot have real dead bodies in the press" rule.
it doesn't matter if you don't like the pictures or if you think he shouldn't put the dead body pics up or if you think he should just shut up, hang his head and do what he is told even though the prosecutors are wrong and they have a judge in their pocket. Every time Wilson loses, we all lose.

lee, I agree with you. he does make it hard for his supporters to keep supporting him. But what happens to him can set a precedent for everyone else; if he gets convicted of obscenity for the lame amateur stuff on his site, anyone could go to jail.

And if Wilson just rolled over and said fuck it, then our fascist govt. and all the right wing fundies win. We are all involved in risks to some degree by being in this industry whether they be legal or social (or health for performers) or otherwise. I'm not comparing Wilson to Flynt, Black, Butts or Hardcore, but did they just give up? Those who appreciate their livelihood in this biz and the right to do so legally ... we fight.

Thank God Wilson has the balls to fight. Let's not forget that his fight ultimately affects the rights of all of us. The Bush Administration is obvioulsy targeting him because of his posting of photos from Iraq on his website. It has nothing to do with the soft porn he has on his site. If they can bully him, they can bully any of us. This is truly a 1st Amendment issue.

Once rights and Liberty are lost, they are very hard to get back. Edmund Burke said; "The true danger is when liberty is nibbled away, for expedience, and by parts." That is exactly what is happening in this case.

I despise the KKK, but I'd fight for the right to march down the street because if they lose their right to express their beliefs, we then, stand risking losing ours.
