Personally, I'd do the double opt-in at this point. Gives you a bit more to defend your butt with against spam complaints.
double opt in and make sure every email you send has an easy to use cancel link.
I only e-mail former members to my site that have paid me in the past and are proven customers. BTW I know my e-mail program is new, but I have never gotten a reply that asked me remove them from my list
many times they won't email you - they go direct to their isps and report you for spam. i believe that legally you don't have the right to send them emails without a cancel link on the email - you can end up in some serious shit.
maybe chad can stop by from phoenix and let us know the legality of sending unsolicited emails with no cancel links...

Even prior to the CanSPam crapola it was a smart thing to do double opt-in IMHO. If there's an email sign up form for a newsletter or mailing list it's subject to abuse. You'll have bozos signing up all their friends and enemies onto your list. You'll have impulsive and forgetful losers who will scream at you, their isp, your isp and anyone else they can think of for putting them on your mailing list. Oh and you'll have people who enter only a portion of their real address or the wrong address...Etc...
Keep your list clean and it'll actually be more profitable -- honest.

So, they don't honour unsubscribes and keep the person on the list, and they don't bother to verify that the email address is valid.
Having a double opt-in *helps* reduce the number of invalid, fake, spammers who are spamming your newsletter and trojans that are mailing to your newsletter address. And of course it helps cut down on the complaints.
The other thing that you can do is physically look at your subscriber list and remove obvious spammer addresses, b.s. email addresses etc... And also other mailing list addresses.
People will sign up other mailing list email addresses and autoresponders; those can often end up on your list if your double opt-in mechanisim allows for replying to the email.
Bounces are allways fun because sometimes it doesn't mean that the email address is permanantly dead. It can mean that the person's email box is full, that there's a temporary network problem or that their ISP is flagging you as a spammer, purveyor of porn or what not....(Unfortunately most of the time you won't even receive a bounce; it'll just go into a black hole.)
Basically keeping a clean list boils down to 4 points. 1. dbl opt, 2. Easy unsubscription process that is honoured; 3. Too many hard bounces cancel their sub 4. keep a keen eye on the actual email addresses.
Anyhoo, just a few of my thoughts on the matter drawn from the years I put into sending out newsletters, mini courses, and promo emails.
How 'bout using that thingy where one has to type the letters/numbers he sees in an image and still use double opt-in?
would that help reduce the misuse without hindering the user?

we have a members e-mail latter and yes having the system send an e-mail to the persons adress where they have to click on a link to verify is worth its weight in gold. we keep a seperate log of the non verified and you would be suprised at what people try to put in like bush@whitehouse.gov so definatlyt use this as a screen to help the lists.
over that and the cancel link , the only reason those graphic letters weer put into systems was to stop robot signups and those are more for systems like domain registrations or things like that, I dotn think a robot sigining up for 1000 e-mail letters or a porn info will benifit the robot owners so I wouldnt bother with that part.

None anymore I got tired of being a listmaster and trying to get my email through to everyone after 5 years of mailing.
But I've used majordomo -- ugh and old. ezmlm (easier but ugh -- and old by now), a desktop mailer which I will not even bother naming. And lastly, a list managment service named aweber -- which was the best. Unfortunately they don't allow porn or sex related mailings.
If you go to cgi resources or php resources you might find something that will work for your needs.
Sorry I can't be of any more help in the recommendations area.
