"children" on porn sites.. is this illegal?

At what point does it become illegal to have a kids pic on a porn site? I found a site that has a kids picture in the members area, obviously VERY under 18 but FULLY CLOTHED. More than likely an oversight, the rest of the site looks fine, its one pic in a header in a gallery. It looks like they used a gallery template builder and not seen the kid.

So is this ok?

IMO, anywhere on a porn site, you should not use kids pictures. Period. I would email them about this. If this is indeed an oversight, they can just fix it.

That isn't CP but it has no place on a porn site.

I advise never ever ever never have any pic of any person under the age of 18 on your sites. Ever.
