    Check this blog for your stolen videos

    http://texasporn.blogspot.com/

    Hi guys. I just ran across this blog that is linking to full uncut videos that are being hosted at DailyMotion.com. I haven't had much luck searching DailyMotion just yet but I'm working on it. You are supposed to be able to double click the video and be taken to the DailyMotion page just like in YouTube, but I keep getting 404 Not Found Errors.

    We wrote to the owner of the blog and got our video pulled, but then they posted this passive aggressive notice making him look like the victim of the big bad porn company who is withholding from him and his readers the right to look at free porn.

    Anyway, just thought you would all like to know in case you see some of your videos here and would like to write to our little Texasporn blogger friend to have them removed.

    he did make you sound like the bad guys:

    This afternoon I received an e-Mail from the Production Manager at RandyBlue.com. His e-Mail was very polite but he “requested” that I remove his videos from the site. He also sent an e-Mail to DailyMotion.com providing them with a list of the various videos from RandyBlue.com. As you will see, they have removed them from their site, because the content was “reported to be in violation of the Terms of Use” so they are no longer available.

    I apologize to each of you for any inconvenience this may have created for you. I will continue to try to provide you with the best free gay porn on the net. If you have a suggestion about this situation, please let me know.
    so you're the bad guy while he's an honest content thief??? what a jerkoff!

    There's at least one Corbin Fisher video there and several Bel Ami that I saw.

    Looks like they had a *bunch*of Randy Blue vids, I can see why it was a problem.

    what is it with these types of operations? - unbelievable (as it always is)

    at least the brands are clearly visible ! HELLO!

    really makes you wonder why we (studios) bother to produce hundreds of thousands of dollars (millions) in content - !

    This concerns me as well.

    Being a smaller studio it was heartbreaking to see two of my sites fully uploaded to a torrent (which is now closed, but resurected under a new name a week later)

    DRM doesn't work. Nothing works. Is there something I'm missing or are things just fucked for us?

    It's not "free" porn - it's "stolen" porn

    I know that my videos end up on peer to peer networks, as well as user groups. But for a site (blog or not) to put up copyrighted content is beyond me. They knew it was copyrighted because they show the copyright watermark and they name the site it came from. So for them to say "sorry" is BS.
    What i really don't understand is how they make money, if at all. The bandwidth must cost a ton with all of the videos. I have several affiliates who post blogs with short clips of my videos and then send me signups. They make money and everything is kosher. But these guys didn't have any affiliate links. Weird.
    I didn't find any of my videos on there, but if i had i wouldn't have bothered writing them. You need to write to their bandwidth supplier and let them know that their customer is violating copyright laws and that, now that they supplier has been notified, they must take action. I've had more than one site shut down doing this. They'll show up again, but it's a major hassle to find another provider with sufficient bandwidth.
    And, of course, there's always the threat of lawsuits. If several studios got together and had a single lawyer send a letter to the blogger, he may think twice about continuing to provide stolen porn.

    If you get the chance, write blogspot / blogger as JakeCruise mentioned. With the blog he made making you look bad, you can see that no way is he going to deal with anyone in a professional way.

    Plus he is giving us Texans a bad name

    To contact Blogspot go here: http://help.blogger.com/?page=contact

    WARNING: If you submit anything under "copyright infringement" you'll just get an autoresponder with the below information so I suggest submitting under another category under "report a TOS violation" perhaps "impersonation" (impersonating the copyright holder) or "illegal / other"?

    ~~~~~~~~~~
    Hi there,
    Thank you for your note. It is our policy to respond to notices of alleged
    infringement that comply with the Digital Millennium Copyright Act (the
    text of which can be found at the U.S. Copyright Office website:
    http://lcWeb.loc.gov/copyright/ ) and other applicable intellectual
    property laws, which may include removing or disabling access to material
    claimed to be the subject of infringing activity.
    To file a notice of infringement with us, you must provide a written
    communication (by fax or regular mail, not by email) that sets forth the
    items specified below. Please note that pursuant to that Act, you may be
    liable to the alleged infringer for damages (including costs and
    attorneys' fees) if you materially misrepresent that you own an item when
    you in fact do not. Indeed, in a recent case (please see
    http://www.onlinepolicy.org/action/l...opg_v_diebold/ for more
    information), a company that sent an infringement notification seeking
    removal of online materials that were protected by the fair use doctrine
    was ordered to pay such costs and attorneys fees. The company agreed to
    pay over $100,000. Accordingly, if you are not sure whether material
    available online infringes your copyright, we suggest that you first
    contact an attorney.
    To expedite our ability to process your request, please use the following
    format (including section numbers):
    1. Identify in sufficient detail the copyrighted work that you believe has
    been infringed upon. This must include identification of specific posts,
    as opposed to entire sites. Posts must be referenced by either the dates
    in which they appear or the permalink of the post. For example,
    http://example.blogspot.com/archives...e.html#2104575.
    2. Identify the material that you claim is infringing upon the copyrighted
    work listed in item #1 above.
    YOU MUST IDENTIFY EACH POST BY PERMALINK OR DATE THAT ALLEGEDLY CONTAINS
    INFRINGING MATERIAL. The permalink for a post is usually found by clicking
    on the timestamp of the post.
    3. Provide information reasonably sufficient to permit Blogger to contact
    you (email address is preferred).
    4. Include the following statement: "I have a good faith belief that use
    of the copyrighted materials described above on the allegedly infringing
    web pages is not authorized by the copyright owner, its agent, or the
    law."
    5. Include the following statement: "I swear, under penalty of perjury,
    that the information in the notification is accurate and that I am the
    copyright owner or am authorized to act on behalf of the owner of an
    exclusive right that is allegedly infringed."
    6. Sign the paper.
    7. Send the written communication to the following address:
    Google, Inc.
    Attn: Blogger Legal Support, DMCA complaints
    1600 Amphitheatre Pkwy
    Mountain View, CA 94043
    OR Fax to:
    (650) 618-2680, Attn: Blogger Legal Support, DMCA complaints
    As far as the bandwidth goes, the videos appear to be hosted on DailyMotion.com. The blogger doesn't make money off his blog, he just gets a head trip for posting free (ie stolen) porn and having people comment on his blog thanking him profusely for making them happy. While a lot of people blog as a means of commerce, there are still tons of people who blog for fun. However, it's one thing to post a funny YouTube video or a news story (giving credit to the source, of course) but this business of posting someone else's hard work is crazy. And the blogger acts like he's so put out by this and he's so sorry to his readers that the big bad porn company came and took away their free porn.
    Hmmm, interesting.
    http://texasporn.blogspot.com/2007/0...-asswipes.html
    How do you suppose someone who works outside of the industry knows that they've been talked about on industry specific message boards?
    And I like how we are accused of being unprofessional because we asked him to remove our videos, which he didn't have the right to post in the first place. You can't win with these people. He calls us "shady Double Dealing Asswipes" and states that I'm spreading lies on message boards. What lie? He's showing our full movies on his site without permission. Do these people think that the movies just appear out of nowhere? Do they think we discovered them in a magic porn cave and are hording them for our own use? No, people in this industry spend thousands of dollars to make these movies so why does this guy and others like him think he has the right to make them public?
    I think the thing that really gets me mad is that he can post his nasty comments and name calling on his blog and not let any of us have a chance to respond.
    Also, answer me this, what good is signing up someone as an affiliate who's going to download your full movies and play them on his site for free anyway? Is anyone who goes there really going to click on your banner and join your site?
    LOL! Don't take it personal! Of course they are mad you made them stop STEALING your content. Our Legal department sent Google/Blogspot a C&D about this blog yesterday.
    If others do the same thing then the site is legally a "repeat infringer" and the whole site will get taken down. We have been able to have 15 or 20 entire blogs taken offline.
    Don't "ask" them nicely to take it down, it doesn't work in the long run. Your stuff will come down for a while and then go right back up. You have to do a legally binding C&D that is complaint with the DMCA.
    People posting entire scenes or entire films are STEALING from you. You are losing a lot more from them then you will ever gain from the occasional person that might actually buy your VOD. These are not people you can trust or want to do business with...they are giving your content to tens of thousands of people for free!
    Don't feel bad about taking them to task and shutting down their sites if need be.
    Oh, I don't feel bad about it at all. I just get angry when someone puts themselves in a position where they can spout whatever garbage they want about whomever they want and then make it so that party can't respond. But then again they wouldn't do that if they didn't know that they were really in the wrong. It reminds me of the bratty little kid that yells names at people and then runs behind their mother for protection, acting like the victim.
