Blogs - Where do they stand?

I'm still up in arms as to where Blogs and blog content stands with 2257/4472.

The content is hosted on my site, the programs site or an image hosting site... but it's nested under my domain.

Anyone have more insight?

The general word from the attorneys who have spoken on the issue (prior to the new regs yesterday) say if it's under your URL, you better have records.

As of the new regs, it seems very clear that you need records, at least according to my read. A full 2257 statement (not just a "click here to read the statement" link) is required on every page of your site, and you are required to have records for any content put up under your site URL after july of '06, even if it's simulated sex or dicks not being touched (which were exempt before).

I'm still confused on this ... I keep seeing posts that say if it's a feed, and something we have no control over, we don't need docs. Otherwise, we better be posting only vanilla images to push a sponsor if we're hosting the picture/video.

That was my take. It's under your .com and On your page. Even if it's a feed or off site hosted.

of, or otherwise managing the sexually explicit content, of a
computer site or service that contains a visual depiction of,
sexually explicit conduct * * *

(a) * * * In this paragraph, the term `copy' includes every page of
a Web site on which a visual depiction of an actual human being engaged
in actual sexually explicit conduct appears.

But where it gets funky...

(iv) The provision of a telecommunications service, or of an
Internet access service or Internet information location tool (as those
terms are defined in section 231 of the Communications Act of 1934 (47
U.S.C. 231)); or

(v) The transmission, storage, retrieval, hosting, formatting, or
translation (or any combination thereof) of a communication, without
selection or alteration of the content of the communication, except
that deletion of a particular communication or material made by another
person in a manner consistent with section 230(c) of the Communications
Act of 1934 (47 U.S.C. 230(c)) shall not constitute such selection or
alteration of the content of the communication; and

So where I see feeds as being a transmission, your site as an information location tool and the feeds being unedited, I also see them as a scape goat for acting upon your own assumptions and getting in a lot of trouble.
