Question for DVD Producers

Utah : 84000 thru 84199, 84300 thru 84799

Montana : 59100 thru 59199

North Carolina : 28200 thru 28299

You shouldnt send ANY adult related materials to the 'unsafe' zip code list because if you do, you'll end up in a world of hurt like Max Hardcore.

That list is actually pretty small to, ive seen a list thats almost 10 times the length of that before $0.02

This is a smaller list. We don't ship to any of TN, OK, most of FL, any of UT, and pretty much all of the other locations listed.

People run of two views on it, I've heard some say their attorneys say the list is outdated and it's ok to ship everywhere. We prefer to be conservative.

A few years ago, we called our local postmaster general's office and inquired about shipping restrictions by zip code on adult products.

He replied that if the customer ordered it we could send it, regardless of zip codes. He said that the postmasters office does not maintain a do not ship adult products list of States, Counties, Cities or zip codes where it is illegal to send adult products. I found this to be odd as I thought the Postmaster General's office was usually involved in any federal crimes involving the mail.

We, however, still maintain a do not ship list of zip codes as we have always not wanted to be the one to make waves or try to pioneer new ground.

The laws vary from state to state but for the most part the only places you can't ship are in the Bible belt. Certain states have requirements like Utah that prohibit content with no plot or any type of storyline.It's always best though not to test the waters! If there's any type of question about the shipping laws into a state or zip code, why chance it? There are several states that you CAN ship adult product to, is the headache worth the extra 70 bucks?? I think not.

Technically speaking, everyone that delivers any product, physical or otherwise, is shipping product into areas that are not considered safe for porn shipments.

It's not just a matter of sending a product to a zip code, or State, but the fact that you are delivering adult material to that Zip Code or State, regardless of how it got there.... Mail, DHL, UPS, and dare I say .....
Internet?

We all are guilty of this already. How do you NOT send internet access to your website to someone living UTAH? A warning screen on the website with a disclaimer about location of viewing? The product is still sent there..via the internet...just as adult products with warnings in the packaging of the product declaring it to be an adult product are shipped there by physical means.

In a year or so, the physical shipment to zip codes will almost be a non issue as the majority of delivery will be digital...... so what is the legal liability then?

Understanding that there are obviously loopholes in certain laws regardless of how they're enforced. if anybody really wants to know weather or not a state or the federal government will prosecute an individual for shipping adult content into the "wrong" state and or zip code....Call Sami Harb at Movies by Mail in Ohio. He was just indited by a federal court in Utah for shipping adult content into the state. He will have to defend himself for shipping films (legal films) into a state that requires all adult content to have some type of plot or story line. He in fact shipped "gonzo" type films and because of that the state and government found just cause to file formal charges against him. The bottom line is that if anybody wants to test the waters this is a free country. All I'm saying is that it's not worth the extra few bucks you can make because if you ask Sami that 100 bucks he got for the sale will cover about .0001% of the legal bills he'll incur to defend his right to ship content into a state that allows internet access to the same content.

So is there a place where I could find a good list to adhere to? Or, is anyone willing to share their list with us? :cop: :whip:

We have, in the past, always shipped anywhere...but I am starting to get more conservitive in my old age....especially now that I own a house and no longer rent! ;o)

If you know someone at TLA they could most likely direct you in the proper direction. The actual list has several places you'd never think has laws forbidding shipping adult content. The last time I saw the list(last year) there were even several zip codes in New York state. I would try and get a couple of different lists though and verify everything before just canceling all shipments to certain areas. It may take a little time but I'd rather spend 2 days checking on something than 2 years wondering why I didn't!
