When only government agencies can actually register domain names with the .gov TLD?

Ive never been able to register a .gov or a .edu domain so how are the SE spammers getting away with it?

They do not own the domains they are finding exploits in message boards or having people with .gov access (students) upload redirects.
Google loves .gov.

Until about 5 years ago, there was no policing of the .edu domain and there are a ton of fraudulent schools (and probably a few porn sites) that have .edu domains. Educause, who controls the .edu registry, is fairly aggressive about newly issued .edus, but has done little to nothing to try to revoke the improperly issued .edu domains back when Network Solutions was handling the registry.

I think the .gov is much more tightly regulated, not sure who runs that registry.
