    I Wonder? DMCA Advice

    Hey Guys,

    Found another ass face posting stolen content, but in this case I'm having some trouble figuring out where to send the DMCA notice(s)...

    He seems to be an affiliate for Silvercash and is using our content to promote his Silvercash programs. He created pages that look like splash/landing pages for the sites he is promoting and then just links to them. But the content on HIS pages are not from the sponsored program.

    I did a whois search that came up with:

    I've emailed a DMCA to the above address, but i have a feeling that will be an unmonitored address.

    Now for my questions...

    1) Could/Should I contact silvercash about this? I doubt they would give me any info, but should they be aware their affiliate is using stolen content to promote their program?

    2) How do I find out who his ISP is, to send them a DMCA?

    3) Epoch does the billing for Silvercash, should they be notified?

    Any advice is GREATLY WELCOME!!!! I'd like to try and take care of this myself so I don't have to bother Chad with something lame

    I wouldn't waste time with either Silvercash or the affiliate, my experience is those sort of affiliates know they're stealing content, so you have to go to the ISP.

    His bandwidth provider is Silicon Valley Web Hosting (www.svwh.net). It's actually being resold by somebody else in Panama to the affiliate who is in Toronto, but my suggestion would be to DMCA the host, since they are responsible for the IP address and ultimately will be on the hook. Usually they, in turn, will get in touch with the reseller who will either remove the content or instruct the affilate to do so.

    What Chip said is right on. Though it wouldn't hurt to send an email to Silver Cash.

    Best way to find out the isp is to do a traceroute and look at the last entry. That is usually who is providing the BW. Sometimes to a reseller.

    i've had pretty good experiences contacting the programs - within limits. if the program can't get hold of the affiliate, there's not much they can do. i've also had good luck going to the host first, but that depends on the host.
