    When Registering New Domains

    Are you cautious about the words you use in them?

    For example, would you use words such as Titan/Titans, Falcon/Falcons, these are two extreme examples but i have found a couple of domains im toying with the idea of registering but a word in a couple of them are used by well-known studio names and i dont want there to be any confusion between the site and the studio as thats a potential legal action.

    What are your thoughts on this, do you think it would be best to just leave these domains alone and try to find different ones or, because there is no intention of trying to confuse the surfer, do you think i should go ahead and register them, despite one of the words being related to gay porn via an existing studios name?

    If you literally mean using Titan or Falcon, I can only encourage you to run far far away from the temptation!

    when I decide on a name I do a search to see who already has it and/or names which closely resemble it , it's not in my nature to just grab a name or snag a picture just because I think it's "catchy" or "cute"

    If you're using a generic word, such as Titan or Falcon, and a reasonable person wouldn't confuse the use of that word with the use of the trademarked name (in this case, Titan Studios), then there should be no problem.

    For example, "Titans of Steel" should not reasonably make anyone think that you're trying to borrow from Titan's branding unless you intentionally try to confuse the issue by using similar imagery, etc. On the other hand, if you chose a name like "TitanHunks" and feature a lot of models that look like Titan guys, then they are likely to have a problem with that.

    The truth is, most companies may rattle their sabers and send a million threatening letters, but very few will actually pursue a trademark action because it's really expensive. And if you communicate clearly that you're not trying to associate yourself with a branded trademark or servicemark, then the trademark owners shouldn't have an issue.

    I'd be careful of "big names" just to avoid a hassle. With my last batch of domains, I gave myself the go-ahead on domains only that did not have active domains of an identical name other than the spelling. If it was a parked domain, I went for the one with alternate spelling (ie., boys vs boyz).
