    Some questions for content sellers...

    I must admit that the idea of starting up a pay site with content shot by others never occured to me, but now I'm seriously considering it. I just had a few questions for any content sellers (or buyers who know the answers):

    1. If a buy a photo/video set of a guy, am I allowed to identify him on my site by whatever name I want (except for his real name) and write up my own bio on him?

    2. When you buy the content is there usually an expiration date attached for how long you can publish it?

    3. Am I allowed to put watermarks on the pics and videos with my site name?

    4. Must I credit the original producer of the content?

    5. Do content sellers have any say in how I price the membership fee for my site?

    6. And finally, do you think buying content is a good way to get a site launched until I can start shooting my own models? The idea seems to make sense since it might help me generate income that I can roll back into my own original productions. Sort of like priming the pump, so to speak.

    My responses will mirror Lee's but I'll dive a little deeper into our policies:

    1) Yes. We ship content with Stats, Bio's, Stage names, etc. but most of our clients alter that stuff to suit thier specific niche. We have no problems with this at all and there's no verbiage in our contract that prevents a cleint form doing it at all.

    2) No - There is no expiration date but there are other limitations ie: the images / video files can only be associated with one URL. So, if you purchase a set from us for http://www.whatever.com the files are only allowed to be published to that url or a subdirectory of that URL. Also, we do not allow any reselling of our cotent. This helps us control exposure of our models and make sure stuff isn't getting served up on a shitty website. That pisses off the models and the other clients. We also do not allow our images to be used for TGP marketing .. our photos have to be behind password protected / member only pages.

    3) Totally - once purchased you should try to incorporate the images into your sites look and feel as much as possible. For an extra fee we will ship content pre-watermarked with our clients logos - most do it themselves.

    4) Nope.

    5) Nope. But we are VERY selective about who we sell our content too. We will get a membership ourselves prior to entering a sales agreement to make sure it's not a chop shop and that models are displayed in a positive, healthy way and that the client is hyper compliant with all regs.

    6)100% yes. Most of our clients do shoot thier own content and use us a filler or back-up service to compensate for slow prodcution months. Having a good relationship with a reliable content provider (like us is a smart business mover regardless of how big or small your site is.

    hey, one quick note, there are some companies that have started using a limited year license when selling their content, saying in the license agreement that its only valid for x years. I always look at license agreements carefully for shitty little clauses like that, and if the seller does not provide me with an unlimited contract I will not buy from them.

    1. yes - i did it myself and it worked well. the only catch is there will often be a few members who recognize the models from other sites.

    2. not usually. i have seen limited time licenses a few times in the last 12+ years, but very rarely.

    3. in most cases, yes.

    4. no, although if you go with a pornstar site, crediting the models by actual pornstar name, it may be helpful to credit famous studios or directors.

    5. nope.

    6. yes. in fact, there are many sites that sell and retain great that have no original content at all.

    The other thing you need to take in to account, if you are buying content to put in a paysite that you will attach an affiliate program to, make sure that you have purchased some content that has affiliate rights attached to it.

    This way, when the time comes to make promo tools for your affiliates, FHGs, Hosted Free Sites, Free Content, etc, you will at least have a few sets that you can offer as 'promo content'.

    Be sure to check licenses for use on FHGs btw, i forget who it was but i found a provider a few weeks back that completely disallowed use of content in FHGs.

    Ounique, GayAdultPhotos and Rainbow Content all offer gay content with affiliate use as do World Wide Content and XXX Content Direct (WWC and XXXCD only allow you to use a certain 'amount' of each movie as affiliate content though).

    Just something that many individuals considering opening a paysite forget about when making their content purchases

    Hey Lee & ALL ...

    we DO NOT allow any of our shared license content to appear on FHG sites and that's actually defined in our TOS. We have turned some business away because of this policy which is not good ..

    Thinking is .. If we allow our clients to use the content on FHG / affiliate marketing type sites we loose control over exposure. At any time I can tell a client how many licenses of a particular set have already been sold and are out live on the web. If we allow our content to be used for marketing like that - I would loose that visibility - no?

    Do you guys think this is a bad move / short sited strategy?
