    Have You Ever Filed For A Utility Patent?

    If so, how did you find the process and did you do it yourself or have an attorney file on your behalf?

    My bf says that you can do it online, although it is not that easy and probably better to get a lawyer. Have you done a search first on the patent you are looking into?

    Yeah we've done several searches for multiple patent applications we'd like to file over the next couple of months time, so far nothing at all has come up for the ones we have searched on, thats why we're looking to get to the next stage with the application process.

    What databases did you search?

    What field is it in? What's a basic idea what it is for without posting too much info?

    We did the searches on the USPTO website, unfortunately i cant really explain what it is even minutely because its actually several really simple processes and we dont want to be beaten to the mark when it comes to filing LOL

    They should prove to be very lucrative patents though

    It sounds like you should speak with a patent attorney then. They know how to write the claims and info needed to make the patent broad enough to cover yourself for your idea.

    A good step before a patent attorney would to have a professional search done on your idea too. Simply searching the uspto site isn't perfect. We can refer you to someone to do that.

    We can refer you to an attorney in Vero Beach, otherwise the other ones we work with are here in the DC area.

    Let me know if you need any help. My bf has been in the patent research business since 1986.

    Patent law is the only area of law that has very specific requirements for its lawyers. Anyone with a bachelor's degree in 12th Century Chinese Theater can go to law school, take a few continuing education classes and hold themselves out as a divorce lawyer, personal injury lawyer or criminal lawyer. The various Bar associations have requirements to gain the designation of "specialist" but only in the area of Patent law is there a second Bar and second Exam. The Bar allows anyone to practice in any area, almost regardless of training, EXCEPT Patent. To be admitted to the Patent Bar the candidate must have an undergraduate degree in some engineering field, pass the Bar Exam, and then sit for the Patent Bar Exam and pass that before becoming a Patent Lawyer. Only the most dedicated attorneys ever get admitted to the Patent Bar and with good reason. The Patent process is wrought with arcane rules, unintentional tricks and traps.

    I hold separate bachelor's degrees in both accounting and economics, I've passed two consecutive Bar Exams in two separate states, been admitted to several jurisdictions and there is NO WAY IN HELL I would try file a patent without hiring a Patent Lawyer!

    I have, personally, but won't speak publicly about it. Especially now.
    Chad knows that of which he speaks.
    Even if you start out on your own, you will quickly find out hiring an attorney is a good idea.

    In my next life cycle, I will likely choose to be be an attorney of some sort.
