What To Do When An Affiliate Misleads The Surfer?

So for the past few weeks i have been having issues with one affiliate promoting Condom Cash as if the sites have $1 trials, which they dont, i have already emailed this guy a couple of times and asked him to stop promoting my sites with the intention of telling the surfer they can join for $1 but i just another site today that he is doing this again on and the domain was only registered 4 days ago, some 2 weeks after i last contacted him about this issue.

At what point would you say that i would be within my rights to terminate this affiliates account for misleading the surfer and misrepresenting the Condom Cash paysites?

I really dont want to have to go down this route but as of right now, the sales he has sent, 50% of them have charged back and my gut tells me it is because he is telling them they can join for $1 when they cant.

Your thoughts? Should i warn him once more and tell him if it happens again his account will be terminated or is there something else i should do to get the message across to this guy?

But... that issue aside, I'd say there's no question you just terminate the affiliate. If you've asked once, and he's still doing it, and you have reason to believe that the current deceptive promotion started after he was warned, then it's really a no-brainer. You don't need people like that promoting you, because they'll just create bad word-of-mouth for your network among surfers.

The fact that his chargeback rate is 50% would have had him flagged for possible fraud with most programs.

Actually, yes they are a lot of my friends tell me they atcually never bother looking at the price of a porn site membership when they go to join because they know they are going to be charged about $30.

I did a test a year or two back with my price points and know for a fact that surfers really dont read all the information on the join page, we raised our prices for about 6 weeks when i was doing this test and made the multiple month join option the first on the join form and set the price at something stupid like $119.95 for 3 months recurring at $29.95 every month after that and had just as many joins as we did prior to the price hike.

My gut tells me that all the surfer really looks at when joining a site is recurring part of the charge on the drop down form, if they see $29.95 as the last price on an option i think they just choose that.

Im pretty sure i could have charged $299.95 for 3 months then $29.95 recurring after that and joins still wouldnt have been affected.

Surfers really are stupid when it comes to price points.

Yeah he is, i just shot him another email with a link to this thread in it.

Hopefully this will get the point across to him that im not just blowing smoke up his ass and am serious about terminating his account if he keeps doing this.

The problem with just terminating him right away is that he is sending over a lot of sales, 5-10 a day and so long as im not getting hit with CB fees (which im not because the ones that have cancelled have actually gone though as refunds) ill happily accept the new sales, i just want to make sure that he is promoting the Condom Cash sites honestly and not saying that we offer something we do not, im sure if he did both he and i would make a lot more $$$ from his traffic in the long run.

Yes i know, thats why i want him to send those sales without claiming that we only charge $1.

If he can still send that amount of sales its win/win.
