    who has fisting sites and are they legal in america?

    i was wondering who had fisting paysites that i can promote i know the gunzblazing have one but i am wondering if they are legal to promote in the us do you think i should promote these types of sponsor or is it not quite legal over here?

    We had the same questions a couple years ago. Yes, they are legal.

    Well, they're legal until some backwater court in Podunk county USA declares fisting obscene in its jurisdiction.

    In that case, I would think a warning page or something saying the usual would protect the websmaster? (that this material is not to be viewed in jurisdictions where it is deemed illegal or offensive or whatever).

    I didn't think that fisting sites are legal in the US. I once tried submitting a fisting site to a US based AVS and they wouldn't accept it because they were sure that it would give them trouble. I was also told that it would be risky to host a fisting site from a US server. I eventually submitted the site to a Canadian based AVS and hosted the site from the Netherlands.

    You'll never get a definitive answer because the US is a patchwork of laws and it all comes down to "community standards" in the local community where a given site or dvd or whatever is actually viewed.

    There are certainly places in the US where fisting would probably be thought to be obscene (think backwater town in Tennessee or Oklahoma, for example) and plenty of others where it would not be a problem.

    I know a number of major studios that include fisting in their films, so they apparently feel that the risk of producing fisting content and having it ruled obscene is minimal. I personally do not feel comfortable producing it, but there's enough of it out there that you are probably OK with it, providing that you have moderate risk tolerance.

    This is a good topic, whether about fisting or anything. Considering what Dean said...what would happen in that case? I mean what problems specifically would a website get into if it contained something (let's say fisting) that some community or town somewhere in the US deemed to be obscene? Would the website be sued, the owner put in jail...and how if the website was not created or hosted in that community? I'd really like to know what those possibilities are so I (and none of us) never have to learn it first hand.

    I have heard that they've tried to make fisting defined as obscene but the gay community revolted.

    In fact, I think lesbians were the loudest. Something about it's common practice. As it is for many gay men.

    Or my memory just may be way off.

    If the content were judged obscene (i.e., a jury convicted on an obscenity charge), then the owner of the site and/or producer of the content would be found in violation of Federal obscenty laws and would most likely have both large fines and jail time. There was a recent case, don't remember the details, but it was extreme rape content, I think, where the producer pleaded guilty in lieu of going to trial. I believe the defendants both got fines and jail time.

    Additionally, one can also be charged on a state or local level for violation of obscenity laws, and there can be fines and jail time surrounding that as well.

    As I said before, so far, the feds are focusing on very extreme content, and while fisting is extreme, it's a lot less extreme than some of the other stuff out there, so I would tend to think that fisting isn't likely to be a high-priority target. But if you get some local yokel prosecutor in a small town who gets a hair up his ass about your site or DVDs, you could be charged, and even if you win, you'll blow a ton of money defending yourself.

    keep in mind that different states have different local laws.

    btw, i've always heard that fisting is legal as long as the thumb is showing. the rationale - and it was from people in the industry in the 90s - may no longer apply.

    and content is only legal till it's found obscene somewhere. since there is no clear guidelines about what is obscene, content that has not currently undergone a legal challenge or has even won a case in some district could conceievably be found obscene at a later date or other location.

    btw, since no part of the government has released a list of legal porn niches, nor are they going to, if you're not sure what is and isn't legal for your area, and what is safe to promote, you should be sure and talk to an adult industry attorney. don't take advice from a board. even if the poster is correct about their location, they could be wrong about where you live.

    fist away. I don't think we will see any new obscenity prosecutions in the next few years and fisting hasn't been a common target for previous indictments.

    The common thread among video that was indicted for obscenity is the perceived abuse of women. Gay fisting doesn't really fit that does it??
