    Using iPhone / iPad In A Porn Domain Name?

    Do you think this is a good idea or not?

    Part of me thinks this is more potential trouble than it is worth, even if the words are being used to represent a product being sold, which my understanding is, its perfectly legal to do, for example, you could register the name... ToyotaCars.com and actually be selling 'Toyota Cars' on the domain and there would be nothing that the trademark owner could do about it as it falls under some 'fair trade' law.

    So what do you folks think about using iPhone / iPad in a domain name for a members site, a good idea or not?

    I think that idea is as bad as registering pepsiporn.com microsoftmen.com :snake:

    Could you imagine Microsoft men? Could be nerdy guys with soft small dicks :luke:

    You mean like "GuysWithiPhones.com"

    I think with GWiP since we are not trying to claim the brand as our own... who knows.
    But, the site has been live for a couple of years and Apple has apparently decided that we are fine. So we've obviously towed the line... but I wonder where that line is?

    They might be easy going, though. Apple doesn't own it's own TM, it borrows it from The Beatle's recording company and pays Apple Records every year.

    I was looking into this myself recently because I was going to buy a domain with the words "YouTube" in it but I did some research on the internet and decided against it. What I learned is that its probably all right to do this if you're writing a criticism site (like "ihatepepsi.com") or a non-profit site, but if you're making money off the site you're seriously taking a risk of getting a Cease & Desist letter.

    Apparently trademark law requires a company to go after others who use their name... if they don't, it diminishes the trademarks value and the efforts of the company to protect it in the future. So either Apple doesn't know about GuysWithiPhones or if they do know and are not stopping it, they run a real risk of others appropriating the name for their own use. For example, if someone does a "iPhoneHunks" website and Apple decides to sue, the owner might have a good argument in their favor because Apple allowed GuysWithiPhones. One article I read said that using a brand name within your domain is an offshoot of cybersquatting, which the government has found to be illegal.

    Another thing to consider is branding... you could spend a lot of time and money building a site that uses a popular brand name but on that day you get notified the name has to be changed all that work you did might have been for nothing.

    Having been through several rounds of trademark disputes, domain name fights, etc, I can assure you it's a bad idea.

    And I don't necessarily mean, from the side of what would be perceived as, "the abuser."
