    trademark?

    Ok we are going to register our trademark. The one thing I can't figure out, is which class or classes it falls under. For those of you who have done this before, what class would a porn production company fall under? Thanks for the advice!

    Motion Picture & Film Production Industry.

    That's what we classed ours under. If it's not that, it's something under the lines of "Audio-Visual Production." Either way you want it to be one of those facts.

    When you trademark be 100% certain you include EVERYTHING.
    Be sure to include any company logos you may have
    Any subsidairy companies or businesses you may have.

    The more you cover, the stronger your trademark.

    Such as when we trademarked for the studio... We trademarked:
    Sebastian's Studios
    Sebastian Sloane
    Sebastian's DVDs
    Sebastians Men
    Sebastians Porn
    Sebastian Studios
    and about another 20 names or so.

    A guy played games in the with us... He bought SebastiansPorn.com and we batted heads with him. He would not do anything to meet us halfway with the Trademark. We took the trademark to a lawyer. We ended up having the ability to seize the domain without having to go to court. The more "words" you use, the better your trademark.

    You'll get to a section where it asks you those things. BE SURE TO INCLUDE THEM.

    Also, you must must must MUST copyright your films. That will make your trademark much stronger as well.
    Use the form: Co2d from the copyright office. It's a $45 registration fee. Do that for every DVD you release. If you've already released them, it's never too late!

    Let's say a site like boyfriendbucks.com starts a site, infringes on your branding and uses movies titled as yours and one of your "trademarked names" you can seize their domain and anything on that site to protect your trademark.

    Furthermore, be prepared by a hassle. They will reject your application a few times for what may seem stupid changes to you but in the long run they're vital.

    It is very costly, and I urge anyone and everyone to do this. All it takes is one shady company to come in and immediately take over your brand. Then your fucked because a piece of trash decided to copy you and whatever... You can take everything with or without going to court! Think of it as a site is a mother that beats on a daughter (your product as the daughter) and your Child Protective Service... Your coming in to take the daughter - or the product back.

    We had our lawyer do ours. For 2 companies, I believe we paid just under $3,000. But we have so many assets to cover. For someone to trademark themselves, I believe (correct me if I'm wrong) it's $750.
