World Trade Organization Says 'Fuck You' To Bush - Internet Gambling NOT Illegal

The World Trade Organization explained yesterday why it had ruled that the United States violated its international trade obligations by prohibiting Americans from gambling over the Internet.

A W.T.O. panel that resolves disputes among members gave specific reasons behind the decision, which was issued last March. At the time, the Department of Justice vowed to appeal the ruling and several members of Congress angrily asserted the decision was equivalent to having the rest of the world dictate United States policy.

In its explanation, the W.T.O. said it was not seeking to undermine the ability of the United States, or any of its members, to regulate industry within its borders. Rather, the panel said that the United States policy prohibiting Internet gambling was inconsistent with longstanding trade agreements.

The ruling stems from a case brought in June 2003 by the Caribbean island nation of Antigua and Barbuda. It argued that United States trade policy did not prohibit Internet gambling and that to do so would be hypocritical given the huge overseas presence of American gambling enterprises.

The ruling allowed Antigua and Barbuda to issue trade sanctions against the United States, said Sebastian Sinclair, an Internet gambling industry analyst with Christiansen Capital Advisors. But Mr. Sinclair said it would be unlikely that such sanctions would have any effect.

He said the larger issue was whether another, larger nation might use the ruling to challenge the United States' policy. And he said that the decision underscored a larger problem: that the United States is markedly out of step with many other nations, which not only allow Internet gambling but license and authorize Internet casinos within their shores.

Despite prohibitions against Internet gambling in the United States, millions of Americans participate in the activity, using credit cards or online payment services to wager on sports or games like poker, blackjack and roulette. Americans will be responsible for about half of the $7.6 billion lost this year on Internet wagers, Mr. Sinclair said.

The effort to regulate and prohibit Internet gambling has been particularly tricky for the United States because the operations are based overseas and players are logging on from home.

Mr. Sinclair said the challenges were similar to those facing the music industry, which has struggled to fight piracy over the Internet

Looks like we might be about to see a slew of gambling affiliate programs starting back up in the coming months, i wish it were sooner we used to make mucho dinero from online casinos

wow, lee - i hope you're right. as i was reading the article, i was sort of figuring we'd find this another thing that causes the extreme right to want the u.s. to become more insulated, and to pull away from the WTO.

isn't it funny? virtually every country in the world can get together and say "this is our policy" and we say "fuck you - you're trying to tell us what to do". we seem to feel that we should be able to tell every other country what to do - and i can't see WHY we should feel that way :-/

Oh Lord, you don't know how refreshing it is to hear Americans saying this. We know there are millions of you who think like this, it's too bad the other side keeps putting its morons in your govenrment. After four more years of Bush, I'm hoping you guys will be ready for a change. I know the rest of the world will be.

I didn't even realize that the U.S. government had made Internet gambling illegal. It's everywhere, so I just assumed. That must have been before I got into the business.

There is a lot of gambling at Indian casinos all over the country, so it is growing. The gambling interests don't like competition~~ would you pack up the Family Truckster to drive to the casino, eat their food, stay in their hotels, and shop at their stores if you could stay at home and gamble in the privacy of your home--and use the extra money to gamble more??

This WTO decision is particularly satisfying. It also shows how our world has clearly moved into the current system of international trade.

This is definately an exciting time to do business, and one of the best features of working on the Internet.

Yes and as the EU gets stronger, the U.S. beaureaucrats will find more and more businesses and countries saying, "Fuck you then, we'll just take our business elsewhere."

There will definitely be a lot of opportunities for people and businesses who are willing to embrace this new atmosphere of change.

Gambling is also legal in Detroit. A few years back, Detroiters finally got tired enough of losing so much revenue to Windsor by all the people crossing the river to go gambling, that they decided to vote it it. Now there are MGM, GreekTown and MotorCity Casinos right downtown.

It's going to take a hell of a lot more to bring Detroit back to any semblance of vitality, but I think the added income will help.

I think this has to do with cross-border gambling. They had made it illegal in some regard for American's to gamble at sites run in other countries due to the high risk of fraud. Now the WTO says this isn't right.
