The adult website of www.fearfactorporn.com has just received a “Cease and Desist” letter from a law firm representing the TV show “Fear Factor”. FearFactorPorn.com was launched just two weeks ago on November 25, 2004. Like the TV show the website features contestants competing against each other in several gross/difficult/degrading stunts and games. However, unlike the television show that eliminates each of the three men and three women one at a time during three games, the website features three girls who play for points in mostly sexually oriented “activities”.

In the letter dated December 10, 2004 (which can be viewed at http://www.fearfactorporn.com/letter1.html), the law firm representing Endemol USA Inc, the producer of the television series entitled “Fear Factor”, claims that “fearfactorfuck.com” is in violation of “copyright infringement, trademark infringement, and misappropriation”. The letter also claims that the use of the “Fear Factor” title and logo is done in an “extremely unflattering, derogatory and pornographic manner.” The letter demands an immediate cease and desist of all elements of “Fear Factor”.

Redslip, LLC is the small, 5 year old company behind FearFactorPorn.com. Company president Richard Prag claims it was a gamble from the start: “We took a chance when we decided to use the ‘Fear Factor’ name in our website name and when we decided to use a logo bearing a similar resemblance to that of the television shows’. What I did not expect was for the lawyers to come calling so quickly.” But according to Mr. Prag the show will go on. He has no plans to shut down the website, although he is considering the possibility of changing the name and logo to a less “controversial” one.
