I think it's absolutely appropriate for Yahoo to stand their ground.

What if there's stuff in that e-mail account he would never have wanted his family to see? I empathize with the family, but Yahoo has to stand firm on this one, failing to do so could cause a stampede away from their e-mail system as everyone begins to think "it's not confidential."

There is no way Yahoo should betray him by giving his family his email stuff. Personal mailers like that are to remain confidential, and no matter how much that family thinks they should be allowed to look at it, they're dead wrong.

I would NEVER want to read my dead family member's email. None of my business.

If they give this one up, then there'll be a flood of scammers sending Yahoo death notices in an attempt to gain control of accounts.
