I'm going to come across like a jerk, maybe and I'm probably going to get fired from the anti-piracy seminar for saying this but my attitude is that we spend WAY too much time fighting the people who dont' want to buy our content and not nearly enough catering to the people who DO.
We found that when we stop worrying about piracy and instead focus on making our site worth joining, we make more money, we have more fun doing it and our "fuck it all" factor goes way down.

That is a very short sighted attitude. While you can never stop all piracy, if you don't at least try to keep it at bay you will end up losing it all in the end. Any well run company should be able to do both at the same time. Focus on the customer expericance and have an anti-piracy component.
Yes it's frustrating, yes it's a drain sometimes, yes it seems like you are fighting a never ending battle. But, if you don't then you might as well just shut the doors and find another business. Your content is worthless if it only has a shelf life of a couple of months before it's avialable for free all over the net. No one can afford to make anything of quality if that is the case.
Don't give up so quickly, anti-piracy can and does pay off in the end. We are proof of that.
Squirt- the current laws actually do not protect torrent sites. We have gone after several torrent sites and have shut them down completley. They are a little harder to go after legally, but it is possible.

It doesn't really matter they are located. Having them located in the USA makes it much easier, but having them based off shore doesn't mean you can't do anything about them. We've dealt with German, Spanish and Russian sites and have been succesful.
It all comes down to following the money....they all need money to operate. Go after their money sources and/or flood their ISPs with take down notices and legal demand letters. Most ISPs don't want to have to deal with a legal battle, so they will often kick the site off their system after repeat violations.
Once you put the ISP/Host on notice that the site is violating their own TOU/TOS they then become secondarily liable if they don't do anything about it. This is pretty much the same for hosts anywhere in the world. They all pretty much comply with the Berne Convention and honor the DMCA.
But, I have to say that unless the demand letters come from an attorney they do not carry much weight. To be successful the letters must come from an attorney, or they will pretty much be ignored. When they get an letter from an attorney they know you have spent the money and are serious. It's amazing how much faster people respond when the letter comes from an attorney!
Oh, and the other trick is if the ISP/Host (Google, Yahoo, MSN groups) is not responding fast enough...on the next take down notice you send CC the group "Concerned Women for America" (cwfa.org) and include some wording about how concerned you are that graphic adult content is being made to children. That usually gets them moving real fast! <EG>
I tried to join the group today, was denied and then told they are no longer accepting members. Now the group is gone. interesting.....

Today's 5 posts had mostly pale uncut guys - so that focuses their interest on Euro content.
Then about a half hour ago news that the owner changed the name of the group - a sure sign that the heat has been turned up. Someone needs to notify Yahoo Groups Admin...
