I don't believe it's been used so far in the US in any porn-related prosecutions, though, although it may have been used in a big tax evasion prosecution last year involving a chain of adult stores in Texas.
It is scary that it was a rival porn person doing this... the article that Rocky posted sent chills down my spine as well
I'm not defending Sean here, but consider what is known about the situation: Sean had allegedly settled his lawsuit with Bryan/Cobra, and the settlement provided for Cobra marketing Sean's videos and website in exchange for a % of the profits. This would have brought Sean a considerable amount of money, in that Cobra had a large mailing list, a busy website, etc. and could have sent a lot of traffic to Sean's website and sold a lot of DVDs.
It seems to me that Sean would have had no incentive to want Bryan killed at that point. A month or two earlier, yes, but not after the settlement was made.
Of course, I suppose one could also argue that Sean would be willing to make *any* agreement to settle with Bryan, if he knew that he would never have to honor the agreement that was being made, because Bryan was about to be killed. And Grant (Sean's boyfriend) is definitely on record, fairly close to the time Bryan was killed, as asking around if he knew anyone
And... all I've got to say is this guy Harlow has to be *completely* stupid. Admitting to Sean that he did it, records of renting a hotel room near the murder?!

Yes, I CAN weigh in on this particular issue -- the issue of whether or not an escort company can be charged with pandering in all but California. That has nothing to do with my representation of Sean, which ended when he hired attorney Yates, who I have a lot of respect for and who has a lot more experience than I do in trademark issues.
The issue of a pandering charge possibility, at least in the context of this thread, is twisted. In California, the Cal. Supreme Court determined that hiring someone to perform in hardcore porn was not pandering, performing in porn is not prostitution. No other state has such a state supreme court ruling, so if we are splitting hairs, paying porn actors could still be charged as pandering/prostitution in the other 49 states.
Bringing a charge of pandering/prostitution against a porn actor in another state would be very risky for any law enforcement because of the real possibility that the respective state court could follow the California Supreme Court and determine that paying actors to perform in hardcore scenes is not pandering/prostitution, thus making that state the next Porn Valley and no law enforcement agency wants to take that risk. Thus, theoretically a porn producer could be charged in all but California, but it seems to have been a quid pro quo for the past 25 years that pandering/prostitution is not a charge the prosecution is willing to risk.
In this Virginia case, it is my personal opinion that the pandering/ prostitution charges are just part of stacking -- bringing as many charges as possible to get leverage against the defendant for him to plead guilty to the most serious charges. The lesser charges can be dismissed as part of a plea bargain.
Also, in this case there appears to be an in-call escort operation. That is definitely not selling porn. I would not take these charges as any threat to legitimate porn producers.

In my mind, the truly unfortunate thing is that this will probably not be widely viewed as an isolated incident concerning only those involved. In the public eye it could very likely be seen as something not unusual to porn producers as a whole, and will serve only to further solidify the stigma that porn has of being generally associated with crime... :bs:

Also, Virginia Beach/Norfolk has a history of porn-related prosecutions. One of the owners of AMVC.com (sells very janky low-rent amateur porn, much of which is so unwatchable that AEBN wouldn't even accept it for PPV) was years ago located in the Norfolk/Va Beach area, and was busted (and went to jail) on a zoning charge for producing porn in a residential area. Subsequently, after getting out of jail, they moved to somewhere near Seattle.
I don't know if there were aggravating factors that motivated the prosecution, but the impression I had was that the Norfolk/Va Beach area was not a place where one should be running any sort of adult business.
You're referring to David McKenzie. He ran AMVC out of his home in Hampton Roads, and he was indeed harassed for zoning violations when they discovered he was operating a large business out of his home, but I don't remember ever hearing about jail time. I don't think you can go to jail for a zoning violation, can you? Maybe you can. But anyway, yeah... they relocated to Seattle and he got a business partner, Alan McNulty, who calls himself "The Colonel" and has something of a odd reputation.

Getting back to the Cobra situation, though... seems like Sean Lockhart either (1) knew something was going to happen to Kocis and said nothing, (2) was involved, or (3) tipped off investigators and cooperated with them. But if (3) is true, why would he shoot video with the accused, as has been reported? This is strange, and continues to be strange...
From what I have read online, I don't think that a sex video was ever created, just some video of them running around on the beach was done. Based on an interview at one of those sites you posted, I gathered that Brent didn't feel the time was right to do the video, but that they would talk about it in the future.

I could be mistaken on the jail time, but I vaguely remember David talking somewhere about jail. Could have just been an arrest and release, or I could be remembering wrong.
And I think Dean is correct. Harlow's blog is here and it seems to imply that he went out there to shoot a scene, but didn't... perhaps because Sean and Grant were working with police, and had no intention of doing the scene, but needed to get Harlow out there to get the confession.
If you've just knocked somebody off, it doesn't seem like hanging out with the guy that was the subject of the lawsuits and all would be the brightest thing... or, for that matter, making various jokes and obtuse references to the killing, as Harlow has done in his blog... but then again, Harlow doesn't seem like the brightest bulb in the box. (And does he really have a twin brother?)

It is very wierd, and very much a movie in the making. One of the scarest things about this, is the motive behind it that they are expressing. It is very scary that a escort, turned model, turned producer could/would go to such great lengths to elminiate what they view as competition or a person standing in there way.
Definately makes you think twice about who you are letting into your home for modeling. I am definately glad, that I am not alone when filming models.
Well there are a few things that bother me.
1.) Lack of Police.
If they are wondering about emails or cell phone calls why not get C.E.R.T. in on this? Not high profile enough for the "general" media that's why.
But for us it's a really serious issue.
After reading everything I think there is alot more to this.

Putting one and one together, it looks like Sean and Grant cooperated with authorities and worked undercover. How else did they get audio surveillance? Especially on the beach.
The beach they were at was Black's Beach, in San Diego. It is a nude beach, not a public beach where families and kids are playing. It is also fairly remote, accessing it by either having to walk north for three miles on a rocky, turbulent shoreline from the La Jolla Shores parking lot - or traverse a few hundred feet down a dirt trail on a steep cliff with no steps or guardrail. It is sparesly populated with only an occasional person walking or jogging along the beach. Lifeguards come by once an hour either by jetski or truck. There are no lifeguard towers for miles.
So surveilance would be easy.

It's not nearly that bad... the walk from Torrey Pines is flat and maybe 10 minutes if I remember right, and I agree that the path from the cliffs is tiring, but not particularly dangerous.
But... were you being facetious about easy surveillance? You could certainly keep track visually, but unless there are parabolic microphones with really long range, I don't know how you'd be able to track conversation.
As an aside, I'm guessing the police handling the surveillance were underwhelmed at having to watch Harlow and Sean (and perhaps Grant and Joseph) cavort naked on the beach... they probably had to go and watch straight porn that night to get rid of the images in their heads :)
The lifeguards have ways to listen in. I am always looking out for them when I shoot down there because they have an innate ability to pinpoint us (or others who try to escape for a little xxx rendezvous) when we are hidden deep in the sandstone cliffs. Officers could very well be disguised as tourists on the beach without garnering suspicion. God knows I never get naked when I go down there (shut up, Squirt :-P).
And yes, I hate that fucking walk down and back up that cliff. I have never walked from Torry Pines, but I HAVE walked form La Jolla Shores and hated it. Although I DID find a nice little non-populated spot of nude-free beach with warm water and a nice even tide along the way.
The only problem was the tide on the way back and having to traverse giant, lichen covered stones as it was rapidly rising and becoming ever more threatening.

La Jolla Shores probably *is* a mile or two. I think Torrey Pines is a lot closer. I used to go there fairly frequently when I lived in San Diego, it's a pretty beach and because it's so damn difficult to get to, it tends to not be terribly crowded, which is why I liked it.
Interesting about the surveillance, though. I still remember reading in some guidebook, talking about Black Beach, the phrase "action in the dunes" which always made me giggle, as it sounds like a porn title.
I don't know anyone involved in this but if I had to bet, I'd say there was some kind of drugs involved. You have to be WAY out there to stab someone 28 times.
If I were to guess, I would say that the two glasses of wine found at the scene and the excessive stabbing were part of the plan to make it look like a crime of passion.

(PS: I believe tht I had read somewhere that Bryan was stabbed after he was already dead, which is why there were no defensive wounds on his arms.)

Originally they were saying that the lack of defensive wounds were either because he knew the person who attacked him and that it happened so quick that there was no chance to react. The other guess was that his throat was slit first, followed by the stab wounds.
The fact that Sean Lockhart has yet to be charged with anything in this would lean one to think that he did in fact cooperate with authorities in order to save his own hide, although not saying anything in the beginning and letting Bryan get murdered is still unforgiving.
I can't say that this helps to get closure for those of us who knew Bryan and called him a friend or collegue. I am happy to see that the two that did this were caught, although at the cost of yet another black mark to stain our industry.
