I need help with 2257 stuff... please?

A lot of content was purchased from content sellers like Rainbow Content, Adult Sex Content, a couple others. The images and videos purchased did not come with 2257's even upon request. All that was received was a license.
What should I do? Should I pull the content? Should I claim the sellers as the 2257 contact on 2257 pages? How would I go about this? I'd hate to pull the content, we're talking about over $5k in content purchases.
As of last week the content has been removed until we find out more. Prior to that, we claimed whoever we bought from as the COR.
What do you suggest?

I'm pretty sure you were sent all 2257 docs on the stuff from Rainbow Content but if you are missing any let me know which ones and I'll get them over to you.

All these years later, getting docs is like pulling teeth.

the purchases were done before I came in. I'm cleaning up the aftermath.
When I put in the suggestions for Gaywebmastervideos.com I wanted it to be easy, automated, and ran smoothly so the buyer would only have to come in, purchase, download, and put up the content. all videos are downloaded with a license and 2257s.
I have bought a lot of content from various online brokers. the ones i have found problems with are those that ship physical products to you. But even that is very far in between.

Two answers:

1. The new regulations that went into effect in Jan '09 make it absolutely clear that secondary producers (i.e., anyone displaying the content) must have full 2257 docs, not just contact information to the primary producer. So to be compliant with the law, if you don't have the docs, you should pull thte content down.

2. That said, I know of almost no one who is in compliance with the Jan '09 law, and there have been no inspections since Obama too office. So if your risk tolerance is high, then you can probably leave it up.

Just because there hasnt been any inspections doesnt mean there won't be in the future whether or not Obama is in the office. They could be watching at any given time even now. In either way that's what I had thought. I didn't know if there's some form of loophole or anything so that's why I asked. I would feel safer and would feel job security if I removed the content which is what I've done.

If an affiliate who promotes a sponsor is supposed to keep 2257 records just like a primary producer/sponsor does, then how affiliates are supposed to get these records? Do any sponsors really do this for affiliates?

I'm not talking about purchased content. I'm talking about an affiliate who makes/creates no content, and has blogs/sites that promote sponsors who do make the content.

It's hard for me to imagine a sponsor taking or having time to continuously find and copy records for each and every pic and movie that a sponsor asks for, and do this all week and every week forever. That's just for one affiliate! Let alone a handful, hundreds or a four digit number of affiliaites. And affiliates don't work with just one or two sponsors. It seems the only answer is for sponsors to provide all 2557 records that an affiliate needs in the affiliate resource areas, automatically provided with each download of content, and when obtaining links for hosted content, etc.. But I don't see any sponsor doing this or doing this now or in the future. I'm not even sure if it is totally legal for sponsors to give out private info like that, or maybe it is. I know especially if dealing with sponsors outside of the US, many times it IS illegal.

So I would really like to know how this could possibly work when it seems nearly impossible for affiliates to even get the records in the first place. I don't know why this obviously crucial question hasn't been addressed in any discussion on 2257 discussions that say affiliates also need to keep records.

Not since late summer 2007, when the Govt (Bush Adm) lost an important Court case, and did not want to set itself up for more precedent losses (you can and should Google it yourself, or study the FSC or AVN websites).

As the FSC continues to argue: the only two celebrated cases of minors being featured in commercial adult videos have been one girl and one boy who presented fake IDs to trick producers into hiring them, for their own self promotion.

Of course, no commercial adult video producer is going to risk their business on deliberately using minors, yet the 2257 rule(s) does nothing extra regarding the enforcement of the dark underground illegal child porn ring, which is the true crime, for which many other laws exist to combat.

tim460 has a good point. I am not aware of any sponsor who is offering to provide 2257 records to affiliates. I'm also not aware of any bloggers who have closed up shop because they don't have 2257 records of the models they are promoting.

Of course, I'm not following every adult website and blog on the internet so maybe these things are happening. But from reading the forums everything seems to be business as usual.

The interesting thing about this is that programs don't seem to be obligated by law to provide 2257 documents for the content they let you use or for the visuals in their promo ads that a sponsor would use. But according to the law
a webmaster promoting a site must have on hand 2257 documents for any of this content that they choose to use on their websites.

It looks to me like affiliates might be limited to using text links for sponsors who do not provide documents for their promotional material if it is going to appear on a website of theirs.

This probably will not sit well with some sponsors, but affiliates here in the
U.S. don't seem to have much of a choice in the matter.

There's nothing in the law that obligates a sponsor to provide docs to an affiliate, but the law is very clear that the affiliate must have docs for anything s/he displays on his/her site. So the obvious decision on the part of the affiliate who wants to be compliant is to only display materials for which s/he has 2257 docs on hand.

Responsible sponsors will require that affiliates use approved (2257 exempt) materials, provide hosted materials and handle 2257 for it, or provide 2257 docs to affiliates.

It really isn't that complicated.

Because nobody seems to give a shit, quite frankly. None of the affiliates seem to care that they aren't in compliance, and I honestly think that 90% of webmasters don't even fully understand the requirements for compliance.

The inclusion of secondary producers (affiliates) in 2257A is one of the most problematic parts of the law as far as affiliates are concerned, but affiliates who care can comply. It's just that most don't bother.

Obama's short term deputy attorney general, David Ogden, worked for both
Playboy and Adam & Eve in the CDA / COPA days under Clinton. While Ogden
was in the attorney general's office, their priorities were elsewhere. Now that
Ogden is gone we may see more inspections.

EVERY time you have posted to this thread i have been MORE than honest with you, do you know how long it takes to pull IDs out of every set of content, after downloading every single .zip file you have purchased, to re-zip and re-upload 2257 documents?

I have stated several times that i was working on this, which I still am, its taking longer than i thought it would because there are so many IDs you need and the files are so large.

If you really want me to delete you acct on GWW i will, i honor all such requests.

Not really seeing what the issue is, I've stated I'm working on this for you and still am doing.... You aren't my only customer and i only have so much time in the day to do so much work.

Lee, we have been trying to get the docs from you for more than 2 months now. Every time it's mentioned to you, you give another run around. The very first time I asked you for them you said, "Oh, Didn't Ryan email them to you?" I said no he didn't or they weren't received. You said okay, I'll get them to you over the weekend (2 months ago) the weekend never happened.
Every time I ask you for them, you say, "I need more time." I deal with 2257's every day. Just yesterday I sent AEBN 2257's on 40 different models. It took 2 hours.
