There must be a statement that is false, and the person who made that statement KNEW it to be false but made the statement anyway, and THEN there must be actual harm.

Lets say Webmaster Kettle post "Webmaster Fickle has CP in a secret members area"

In order for that to be actionable [winnable in court] I have to prove 3 things:

Kettle KNEW that there was no CP in a secret members area
There is no CP in a secret members area [the truth is an ultimate defense]
That the business of Webmaster Fickle was actually harmed, and that harm can be proven, preferably with accounting records, accountants, and experts
