In order for that to be actionable [winnable in court] I have to prove 3 things:

Kettle KNEW that there was no CP in a secret members area
There is no CP in a secret members area [the truth is an ultimate defense]
That the business of Webmaster Fickle was actually harmed, and that harm can be proven, preferably with accounting records, accountants, and experts
