In either way that's what I had thought. I didn't know if there's some form of loophole or anything so that's why I asked. I would feel safer and would feel job security if I removed the content which is what I've done.

    I think that is right. But don't expect him to stay in office long. And when he is gone, expect a swing to the other side of the Spectrum for a while.

    If an affiliate who promotes a sponsor is supposed to keep 2257 records just like a primary producer/sponsor does, then how affiliates are supposed to get these records? Do any sponsors really do this for affiliates?

    I'm not talking about purchased content. I'm talking about an affiliate who makes/creates no content, and has blogs/sites that promote sponsors who do make the content.

    It's hard for me to imagine a sponsor taking or having time to continuously find and copy records for each and every pic and movie that a sponsor asks for, and do this all week and every week forever. That's just for one affiliate! Let alone a handful, hundreds or a four digit number of affiliaites. And affiliates don't work with just one or two sponsors. It seems the only answer is for sponsors to provide all 2557 records that an affiliate needs in the affiliate resource areas, automatically provided with each download of content, and when obtaining links for hosted content, etc.. But I don't see any sponsor doing this or doing this now or in the future. I'm not even sure if it is totally legal for sponsors to give out private info like that, or maybe it is. I know especially if dealing with sponsors outside of the US, many times it IS illegal.

    So I would really like to know how this could possibly work when it seems nearly impossible for affiliates to even get the records in the first place. I don't know why this obviously crucial question hasn't been addressed in any discussion on 2257 discussions that say affiliates also need to keep records.

    Because nobody seems to give a shit, quite frankly. None of the affiliates seem to care that they aren't in compliance, and I honestly think that 90% of webmasters don't even fully understand the requirements for compliance.

    The inclusion of secondary producers (affiliates) in 2257A is one of the most problematic parts of the law as far as affiliates are concerned, but affiliates who care can comply. It's just that most don't bother.

    was in the attorney general's office, their priorities were elsewhere. Now that
    Ogden is gone we may see more inspections.

    Not since late summer 2007, when the Govt (Bush Adm) lost an important Court case, and did not want to set itself up for more precedent losses (you can and should Google it yourself, or study the FSC or AVN websites).

    The exact number of inspections is really hard to determine, since some reported events were actually fake press release publicity stunts.

    The 12 months or so of inspections yielded nothing of value to the Govt, except the Girls Gone Wild case, which turned out to be an IRS income tax evasion victory. That company was not hard to find, since it advertised on late night TV, and is still in business.

    Late summer 2007 was the same time that AEBN set up an in-house legal department to ensure 2257 compliance of the movies they carried. For me, that brought to an end the bullying practices of some marketers, who used these forums, and their own interpersonal business practices with producers, to give "legal advice" and promote discriminatory practices as to which producers they would carry or not - under the guise of 2257 compliance.

    As the FSC continues to argue: the only two celebrated cases of minors being featured in commercial adult videos have been one girl and one boy who presented fake IDs to trick producers into hiring them, for their own self promotion.

    Of course, no commercial adult video producer is going to risk their business on deliberately using minors, yet the 2257 rule(s) does nothing extra regarding the enforcement of the dark underground illegal child porn ring, which is the true crime, for which many other laws exist to combat.

    tim460 has a good point. I am not aware of any sponsor who is offering to provide 2257 records to affiliates. I'm also not aware of any bloggers who have closed up shop because they don't have 2257 records of the models they are promoting.

    Of course, I'm not following every adult website and blog on the internet so maybe these things are happening. But from reading the forums everything seems to be business as usual.
