You are a successful, independent studio, with a large catalog and fan following.

The only "friends" you need, are your customers.

The only friends I need are my customers. I also admire the business practices of my partners: AEBN, TLA, HotMovies, BadPuppy's DogGone, GameLink, Amazon, Barnes & Noble. And the USPS for delivering DVD orders to my customers.

I also admire the relations I have had with Dominic Ford and his Porn Guardian staff, and a dozen webmasters and content producers from here who I have bought from or shot with. That list would be longer, and will be longer, as time and budget allow. The consumer can only spend so much, so fast.

Have I gone out drinking with any of them? No! I'm here to buy and sell - for my fan base.

Because you've never heard of me doesn't give me less rights than any other studio that posts messages on this site. Are you saying I have to post hundreds of messages before I'm considered a legitimate person?

I'm chatting with Damian on Skype - as I understand it, Damian is the only one who has signed contracts with producers in the past 6 years (since Ted left). So if you signed with Ted, that means this problem is at least 6 years old

My contract was issued and executed in May of 2009. That's just under 4 years ago. Your information is incorrect!

It would have helped to have some of that info at the top of the thread. Here are the details on your account...

Typically PPV has a $50 min payout for producers. I guess they didn't notice when you went over that since it took so long to happen.

    <sarcasm>
So yes, HUGE scandal... You were owed nearly $59. In an age of people making big money off stolen content and stealing full length videos and offering them up for free, THAT really justifies putting PPV on a blacklist... We just can't tolerate that sort of thing...

I don't post as often as I should, that's true. But that doesn't mean I don't care about this board, maybe it just means I'm a busy man

To be clear, they pay at $100 automatically or you can request payment at $50. You never hit the $100 threshold. He has no record that you emailed him or Ted.

You know I will not be bullied on $50 or $500. The point is he just kept collecting and pretended ignorance that he never heard from me. I have the copies of all the contracts which in fact state I had requested $50 payouts. I also have copies of all the emails to Damian, Ted and customer service that no one ever answered. Not One!

You seem to think your job is to intimidate people on this board and bully them into accepting what you have to say but I will not! I'm not sure who you think you are but you are no one to me and I do not accept your continued harassment of a perfectly simple question at the beginning of this thread.

"Anyone ever hear from them" was what I asked. I posed the question in hopes of getting some contact information to deal with this privately but instead you stepped in and made such a huge issue of it all because I had the balls to ask such a question of someone who was whiter than white in your books.

The amount is small yes, but there was a contract in place which was ignored. It could have been cancelled and I would have been ok with that decision as well.

All I wanted to achieve was to have my videos removed from his site. He can keep the money!

You come on the board and in under 10 posts are asking for someone with a solid, established reputation to be put on a blacklist. Someone who we know well. Someone who is our friend. We weren't being bullies, we were being friends.

Who *is* the "head hauncho* here? Kinda wondered this for a long time.
awww .. I wuvs you too! Stunner Media has owned the board since Luke sold off his properties to them, so I would say Jay is the "head hauncho" now.

This is one point that I want to address.

As it relates to blacklists, there is in my opinion a huge difference. In my decision to remove Damian from the blacklist I took one thing into consideration. The contract that you have with Damian or whoever else you sell your content to. I nor anyone else on this board knows what your contract says. I don't feel that it is the goal of a board to mediate disputes between a content provider and the program.

As it relates to affiliate programs and payments the contract is public. It is the TOS. If a company says in the TOS that they pay twice a month and 30 affiliates say they haven't gotten paid in 3 months then it's pretty damn clear the program isn't paying and deserves to be on a blacklist. I can see the "contract" between the program and the affiliates. And yes, I do check. There are some programs that have a six week hold before they make their first payments to affiliates and affiliates not aware of that do complain that they haven't gotten paid their first check and it's been three weeks. Not going to put that program on a blacklist.

I have never seen your contract with Damian or any other program you sell content to for that matter, nor do i want to. We deal with many content producers and have different contracts with some of them with different terms. How can a board possibly mediate that when they don't even know what the contract says? Our contract with producer XYZ could very well be different than producer ZYX. Damian may or may not have different contracts with different producers. Not this board's business to know that. Nor is it really anyone else business to know the details of our contracts with our producers and the price we pay for content and on what terms. Sorry.

It seems like you had an issue and you felt emails didn't get answered to a problem you had. If we blacklisted sponsors for not answering emails there would be none left to market. As for the contract and non payment issues, it can't be the goal of a webmaster board to mediate between a content producer and a program owner on a contract that we have never seen nor have any desire to see as this is not a court of law.

As for Nick sending a spindle of DVDs and not getting them back. Don't even get me started...

I apologize that this got way out of hand. My initial thought was to get more current contact information which never did materialize during this thread.

I never intended this board to mediate at all. I was asking for the experience of other studios.

    For that I apologize.
